Indian River County Solid Waste Disposal District <br />Solid Waste and Recyclables Franchise Agreement <br />15.7.2. At all times when operating vehicles or equipment pursuant to this Agreement, Franchisee's employees <br />shall carry a valid Florida driver's license for the type of vehicle or equipment being operated. <br />15.8. Removal of Employees <br />15.8.1. The Contract Manager reserves the right to disapprove or request removal of any Franchisee personnel <br />assigned to the Agreement. Such disapproval or request shall be for reasonable cause and shall be addressed <br />in writing to Franchisee's Operations Manager. Notwithstanding the foregoing, Franchisee shall not be required <br />to take any action with regard to Franchisee's personnel that would violate any Applicable Law. <br />ARTICLE 16. OFFICE AND FACILITY <br />16.1. Customer Service Office <br />16.1.1. Franchisee shall maintain an office located within Indian River County with a local number that is <br />answered by staff located at the customer service office unless otherwise approved by the Contract Manager. <br />At a minimum, such office shall be open between the hours of 7:00 a.m. and 6:00 p.m. Monday through Friday <br />and Saturday between the hours of 7:00 a.m. and 12:00 p.m. for the transaction of business, unless during <br />Holidays or otherwise approved by the Contract Manager. <br />16.1.2. At a minimum, Franchisee shall have personnel available for the purposes of dispatch, complaint <br />resolution, and other matters between the hours of 6:00 a.m. and 6:00 p.m., Monday through Friday and <br />Saturday between the hours of 7:00 a.m. and 12:00 p.m. The office shall be equipped with a two-way <br />communication system to contact the Collection Supervisors, all Collection vehicles, and Franchisee's dispatcher <br />(if applicable). <br />16.1.3. The office shall be equipped with sufficient telephones, and shall have a responsible, experienced <br />person in charge during Collection hours. Franchisee shall provide a voice mail system when the office is closed. <br />16.1.4. Franchisee shall provide a process for receiving and handling emergency calls both during and after <br />normal operating hours. Such process shall be subject to the Contract Manager's approval. <br />16.1.5. Upon request of the County, Franchisee shall provide adequate office space to house County personnel <br />to monitor Franchisee's operations and compliance with the Agreement. <br />16.2. Operations/Vehicle Maintenance Facility <br />16.2.1. Franchisee shall have an operations/vehicle maintenance facility located within Indian River County <br />unless otherwise approved by SWDD. <br />ARTICLE 17. COMPLAINTS AND DISPUTES <br />17.1. Calls and Communications <br />17.1.1. Franchisee shall maintain a log of all calls or other communications received from Customers or from <br />SWDD related to services provided under the Agreement, including all inquiries, complaints, and compliments <br />(Customer Call Log). The log shall be developed and kept in accordance with ArticleARTICLE 18. <br />17.1.2. The Customer Call Log should specifically identify Missed Collections and Legitimate Complaints. <br />Legitimate Complaints can be based on SWDD observations, reports from Customers, or County review of <br />Franchisee's Customer Call Log, service verification tracking, or other records and reports. Legitimate Complaints <br />shall include any instance when Franchisee did not perform Collection Services in accordance with provisions of <br />the Agreement including, but not limited to, the following: <br />a. Missed Collections. <br />b. Continued or repeated misses of a particular Customer or segment of the Franchise Area. <br />c. Misuse and/or mishandling of Solid Waste or Collection Containers. <br />d. Damage to public or private property. <br />30 <br />
