6706-050 <br />ARTICLE 6. CONTRACTOR'S RESPONSIBILITIES <br />SC-6.3. <br />Add a new paragraph lmmodiately after paragraph 6.3 of the General Conditions <br />which Is to read as follows: <br />6.3.1. Regul ar working hours are defined as 8 hours per day, Monday through <br />Friday, excl uding holidays, between the hours of 7:00 AM and 7:00 PM. Requests <br />to work other than regul ar working hours shall be submitted to ENGI NEER not less <br />than 48 hours prior to any proposed weekend work or scheduled extended work <br />weeks. Occasional unschedul ed overtime on weekdays may be permi tted provided <br />two hours notice Is given to ENGI NEER. <br />6.3.2. CONTRACTOR shall reimburse the OWNER for additional engineering and/or <br />inspection costs Incurred as a result of overtime work in excess of the regular <br />working hours stipulated in Article SC-6.3.1. At OWNER's option, overtime costs <br />may either be deducted from the CONTRACTOR's monthly payment re quest or <br />deducted from the CONTRACTOR's retention prior to release of final payment. <br />Overtime costs for the OWNER's personnel s h all be based on the Individual's <br />current overtime wage rate. Overtime costs for ·personnel employed by the <br />ENGINEER or OWNER's independent testing l abdretory shall be calculated In <br />accordance with the terms of their respective contracts with the OWNER. <br />6.3.3. This Agreement is subj ect to the applicabl e provisions of the Contract Work <br />Hours and Safety St andards Act, Public Law 87-581, 87th Congress. No <br />Contractor or Subcontractor contracting for any part of the Work shall require or <br />permit any laborer or mechanic to be employed cln the Work in excess of forty <br />hours In any work week unless such l aborer or mechanic receives compensation at <br />a rate not less than one and one-half times his basic rate of pay for all hours <br />worked In excess of forty hours In such work week, es the case may be. <br />6.3.4. CONTRACTOR s hall employ only competent persons to do the work and <br />whenever OWNER shall notify CONTRACTOR, in writing, that any p erson on the <br />Work appears to be incompetent, disorderly, or otherwise unsatis factory, such <br />person shall b e removed from the Project a nd shall not again be e mployed on It <br />except with the consent of OWN!:R. <br />SC-6.8. <br />Delete Paragraphs 6.8.1 and 6.8.2 of the Gcnor,.I Condition,; In their entirety .,nd <br />insert the following in its place: <br />00800-l 1 <br />111•11•
