CONTRACTOR shall not employ any Subcontractor, Supplier or other.person <br />or organization, (Including those who are to furnish the principal Items of materials <br />or equipment), whether initially or as a substitute, against whom OWNER may have <br />reasonable ob)ectlon. Acceptance of any Subcontractor, other person or <br />organization by OWNER shall not constitute a waiver of any right of OWNER to <br />reject defective Work. CONTRACTOR shall not be required to employ any <br />Subcontractor, other person or organization against whom CONTRACTOR has <br />reasonable ob)ection. <br />SC-6.9. <br />Add a new sentence at the end of paragraph 6 .9 to read as follows: <br />6.9.3. OWNER or ENGINEER may furnish to any such Subcontractor, Supplier or <br />other person or organizati on, to the extent practicable, information about amounts <br />paid on their behal f to CONTRACTOR in accordance with CONTRACTOR'S <br />Applications for Payment. <br />SC-6.31. <br />Add a new paragraph Immediately after paragraph 6.31 of the General Conditions <br />which Is to read as follows: <br />6.31.1. The Contractor shall indemnify and savu harmless the OWNER, ENGINEER <br />and ENGINEER's Consultants, agents and emplo'Jees from all suits, actions, or <br />claims of any character brought on account of any injuries or damages received or <br />sustained by any person, persons, or property by or from the said Contractor, or by <br />or in consequence of any neglect In safeguardin{J the work, or through the use of <br />unacceptable materials In the construction of improvements or by or on account of <br />any act or omission, neglect or misconduct of th9 said Contractor, or by or on <br />account or any claimed or a mounts recovered for any infringement or patent, <br />trademark, or copyright, or from any claims or amounts arising or recovered under <br />the Worker's Compensation Law or of any other l aws, oy-laws, ordinances, orders, <br />or decrees, together with all costs including counsel fees if OWNER need defend <br />any such suit, action or claim, and so much of the money due the said Contractor <br />under and by virtue of his Contract as shall be c :msiderod necessary may be <br />retained by the OWNER, or in case no money is ,1uo, his Surety shall be held until <br />such suits, actions, or c l aims for i njuries or damngos, including counse l fees, shall <br />have been settled and suitable evidence to that l,ffect furnished to the OWNER. <br />The Contractor shall guarantee tho payment of e:I just claims for material s. <br />c;upplles, tools, labor, or other Just claims against h im, or any subcontractor In <br />00800-12 <br />2/Jt,Vf,
