DeBloisP <br />Chief, Environmental Planning <br />DATE: September 11, 1996 <br />SUBJECT: PROPOSED PURCHASE OF ATLANTIC GULF COMMUNITIES (AGC) <br />INDUSTRIAL TRACT SCRUB LAAC PROJECT <br />It is requested that the information herein presented be given <br />formal consideration by the Board of County Commissioners at its <br />regular meeting of September 17, 1996. <br />SUMMARY <br />Staff recommends that the Board of County Commissioners purchase <br />(with bond funds) the Atlantic Gulf Communities (AGC) Industrial <br />Tract Scrub property. The proposed purchase contract (already <br />executed by the seller) is summarized as follows: <br />Purchaser: Indian River County Board of County <br />Commissioners / Florida Communities Trust <br />(Indian River County will hold title) <br />Seller: Atlantic Gulf Communities <br />Cost -Share: Florida Communities Trust (40%) <br />(includes share of acquisition costs) <br />Total Price: $400,000 (average +$5,263 acre) <br />Other Costs: +$30,000 (appraisals, environ. audit, title <br />Insurance, management plan) <br />Countq Bonds <br />Sxpenditurez +$263,000 (not including initial management costs) <br />Acreage: +76 acres <br />Principal Condition: <br />• Closing subject to county Commission and FCT Governing Body approval <br />of purchase contract and project plan, including management plan. <br />LAAO Recommendation: <br />• The County Land Acquisition Advisory Committee (LAAO), <br />at its meeting on August 28, 1996, voted unanimously to <br />recommend that the Board approve the purchase contract <br />and draft management plan, with the condition that the <br />management plan be subject to modification depending on <br />whether the County proceeds with acquisition of the <br />adjacent St. Sebastian P.U.D. LAAO site. <br />DESCRIPTION AND CONDITIONS <br />The subject AGC Industrial Tract Scrub property was approved in <br />1995 as a Florida Communities Trust (FCT) 60/40 cost -share project. <br />The property is currently ranked 5th out of 15 projects on the LAAC <br />site acquisition list. The City of Sebastian has expressed support <br />of the overall project because the project will contribute toward <br />alleviating conflicts within the City concerning endangered species <br />protection vs. private development rights. <br />In its application for state cost -share funding, the County chose <br />to be the lead agency for pre-acquisition tasks and negotiations. <br />During the past year, the county's acquisition consultant, in <br />coordination with county staff, has conducted pre-acquisition tasks <br />and negotiations. Since the seller, Atlantic Gulf Communities, <br />recently accepted and executed a purchase contract Option Agreement <br />for the project, appraisal results and other confidential <br />information have recently been released. <br />SEPTEMBER 17, 1996 24 <br />
