He advised he had a problem the <br />prior -night when there was a funeral for one of his clients and he <br />had a very difficult time arranging transportation for other <br />clients who wanted to attend the funeral. He concluded his remarks <br />by stating the Council On Aging is unable to assist him after 5:00 <br />or 5:30 P.M. or on weekends. <br />7) Phone call on August 8, 1996, at 10:10 A.M. from Dennis <br />Carmody of All Florida Transport. All Florida Transport currently <br />holds a Class "E" Certificate of Public Convenience and Necessity <br />to provide wheelchair transportation services. He stated he was <br />not doing much business now, and that it was really dead around the <br />County. He did not feel a need existed for another provider and <br />that business was so slow he had to lay off his driver. <br />8) Phone call' on August 16, 1996, at 3:15 P.M. from Lt. Glen <br />Oberbeck, on behalf of Chief Hugh Cox, of the Indian River Shores <br />Public Safety Department. He advised that Indian River Shores did <br />not oppose Able's application for a certificate to provide <br />wheelchair transportation services. <br />A copy of the minutes of the July 18, 1996, Transportation <br />Disadvantaged Local Coordinating Board was obtained for review and <br />inclusion in the EMS Director's recommendation to the Board. The <br />minutes noted that during the meeting it was determined that no <br />complaints had been received regarding the availability of <br />wheelchair transportation in the community and no additional <br />providers were needed. <br />ALTERNATIVES AND ANALYSIS: <br />Chapter 304 of the Indian River County Code of Laws and Ordinances <br />requires, in part, as follows: <br />1. No person shall provide wheelchair vehicle service in <br />Indian River County without a certificate of public <br />convenience and necessity issued by the Board of County <br />Commissioners, (Section 304.13); <br />2. Any person who provides wheelchair vehicle services where <br />said services are paid for in part or in whole either <br />directly or indirectly with government funds shall be <br />required to have a Class "E" certificate, (Section <br />304.14.3); <br />3. To obtain an "E" certificate a showing of need for the <br />service shall accompany the application...., (Section <br />304.14.4); and, <br />4. All services subject to Certificate "E" of this chapter <br />shall be under written contract with the community <br />transportation coordinator ..... (Section 304.17) <br />Able has informed the EMS Director that the service they are <br />seeking is for private pay clients only, and the company does not <br />intend to bill any governmental entity- for wheelchair <br />transportation services provided to their clients if a certificate <br />is granted. <br />As noted above, Able provided the EMS Director with a number of <br />survey forms which were to some degree seemingly favorable to Able <br />over other providers, oriented toward private pay transports, and <br />indicated the facility(s) preferred having another provider to <br />choose from rather than information directly related to needs not <br />being met. <br />29 <br />Se tember 24, 1996 <br />
