<br />A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF
<br />ORCHID, FLORIDA, RELEASING A PORTION OF A
<br />CONSERVATION EASEMENT RECORDED IN OFFICIAL
<br />RECORDS BOOK 846, PAGE 132 OF THE PUBLIC RECORDS OF
<br />INDIAN RIVER COUNTY; PROVIDING FOR LEGISLATIVE
<br />FINDINGS, RELEASE OF EASEMENT, RECORDING IN PUBLIC
<br />RECORDS OF INDIAN RIVER COUNTY CLERK OF COURT;
<br />AND AN EFFECTIVE DATE.
<br />WHEREAS, Orchid Island Associates Limited Partnership, a Connecticut limited partnership,
<br />as Grantor, granted a Conservation Easement to Indian River County and the Town of Orchid as
<br />Grantees on October 16, 1989; and
<br />WHEREAS, the Conservation Easement was recorded on October 25, 1989, in Official Records
<br />Book 846, Page 136, Public Records of Indian River County, Florida; and
<br />WHEREAS, the Orchid Island Golf & Beach Community Association, Inc., a Florida Not -for -
<br />Profit Corporation (the "Owner") in July 2024, at the request of the Florida Department of
<br />Transportation ("FDOT") in connection with the pursuit of a traffic signal to be installed on the
<br />intersection of Orchid Island Drive and State Route AIA, sought from Indian River County and the
<br />Town of Orchid a partial release for that portion of the Conservation Easement located on Parcel 1811C,
<br />lying within Tract C of Orchid Island - - - Plat 6 recorded in Plat Book 13, Page 15B, Public Records of
<br />Indian River County, Florida; and
<br />WHEREAS, representatives of Indian River County and the Town of Orchid, whose jurisdictions
<br />are co -Grantees of the Conservation Easement, reviewed the request from the Owner prior to the public
<br />meeting of the Town Council held on September 16, 2024, at which the Town Council received detailed
<br />information about the request for partial release and sought public feedback from interested parties; and
<br />WHEREAS, on August 20, 2024, the Board of County Commissioners of Indian River County
<br />Commission held a public meeting to consider releasing and abandoning all right, title, and interest that
<br />it may have in that portion of the Conservation Easement located on Parcel 1811C, lying within Tract C
<br />of Orchid Island - - - Plat 6 recorded in Plat Book 13, Page 15B, Public Records of Indian River County,
<br />Florida; and
<br />WHEREAS, the Town Council of the Town of Orchid after review and consideration has
<br />determined that, subject to an authorized representative of the Indian River County Board of County
<br />Commissioners executing the partial release of easement on behalf of Indian River County, the release
<br />of that portion of the Conservation Easement Iocated on Parcel 1811C, lying within Tract C of Orchid
<br />Island - - - Plat 6 recorded in Plat Book I3, Page 15B, Public Records of Indian River County, Florida,
<br />would be in the best interest of the public health, safety and welfare of the Town and the general public,
<br />as it furthers the ability of the Owner to cause to be installed a traffic signal on the intersection of Orchid
<br />Island Drive and State Route AIA which the Owner has determined will increase the safety ofthe general
<br />public.
<br />NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN
<br />ORCHID, INDIAN RIVER COUNTY, FLORIDA, AS FOLLOWS:
<br />SECTION 1- LEGISLATIVE FINDINGS. The foregoing recitals are hereby fully incorporated
<br />herein by reference as legislative findings of the Town Council of the Town of Orchid.
