DOT's criteria for approving a traffic light at that location will <br />be met. <br />Commissioner Macht felt we should be dealing with an overall <br />traffic plan for the potential development of that whole strip <br />rather than dealing with it piece meal. <br />Bill Koolage of Vista Gardens felt very strongly that the <br />speed limit should be reduced in advance of the traffic lights <br />along there. He suggested that we ask the DOT for assistance in <br />that respect. Director Boling advised that the speed limit is 45 <br />mph between 43rd Avenue and 58th Avenue. <br />Deputy County Attorney Will Collins wished to question <br />Director Boling, for the record, regarding discussion about whether <br />all the traffic cutting down 53rd Avenue from 26th Street is headed <br />for Wal-Mart and the possibility of some of that traffic being <br />headed toward the Indian River Mall. He asked Director Boling, <br />"Isn't it true that the Indian River Mall has its own entrance off <br />26th Street?", and Director Boling answered, "Yes, that is <br />correct." <br />For further purposes of record, Attorney Collins asked <br />Directors Boling and Keating to stand and swear that all the <br />testimony they have given here today is the truth, the whole truth <br />and nothing but the truth, and Directors Boling and Keating each <br />swore to that effect. <br />Attorney Motley took some offense to Commissioner Macht's <br />remarks about Wal-Mart not having lived up to what it has said it <br />would do. She emphasized that Wal-Mart doesn't have to build their <br />store exactly when some particular members of the community might <br />like. <br />Chairman Adams pointed out that Wal-Mart has done a lot of <br />good things in this rezoning process and has been tremendously <br />cooperative. Now, they are asking for some cooperation from the <br />County on the 3 issues, mainly the temporary use permits. <br />Attorney Vitunac advised that the Board could limit the <br />issuance of temporary use permits for one year after which they <br />would ask for a report from staff as to whether Wal-Mart has lived <br />up to these conditions. After one year it would expire unless <br />staff comes back with a positive recommendation. <br />Commissioner Macht felt we are missing the point. Wal-Mart is <br />not surrounded by commercial.
