Part of Parcel No. 28-32-39-00001-0060-00002.0 <br />RESOLUTION NO. 96-124 <br />A RESOLUTION OF INDIAN RIVER COUNTY, FLORIDA, <br />ACCEPTING A CONSERVATION EASEMENT 1;173 COVENANTS OF <br />CONSERVATION RESTRICTIONS PROVIDED IN SECTION <br />704.06(1), FLORIDA STATUTES, AMID ASSESSING SAN$ <br />PURSUANT TO SECTION 193.501, FLORIDA STATUTES. <br />WBffiiEAS, section 193.501, Florida Statutes, allows the Board of <br />County Commissioners of each County to accept instruments covenanting certain <br />conservation restrictions over land; and <br />MBEREAS, a conservation easement was granted to Indian River County <br />by Donald LaFountain and June LaFountain, husband and wife, and recorded in <br />O.R. Book 1076 at Pages 2312z'2_316 of the Public Records of Indian River <br />County, Florida; and <br />1PBEREAS, said conservation easement subjected the land to one or <br />more conservation restrictions provided in section 704.06(1), Florida <br />Statutes, <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY CONNZSSIONERS <br />OF INDIAN RIVER COUNTY, FLORIDA, that: <br />1. The recitations set out above are hereby ratified. <br />2. The grant of a conservation easement over lands described in <br />O.R. Book 1076, at Pages 2312-2316 of the Public Records of Indian River <br />County, Florida (copy attached), is hereby accepted; and <br />3. The conservation restrictions over the real property subject <br />to the conservation easement extend for an indefinite period to Indian River <br />County; <br />4. The Property Appraiser in valuing such land for tax purposes, <br />is hereby notified, pursuant to section 193.501(3)(a), to consider no factors <br />other than those relative to its value for the present use, as restricted by <br />the covenants of the conservation restrictions contained in the conservation <br />easement above referenced. <br />BOOK 99 FAGS 318 <br />75 <br />OCTOBER 19 1996 <br />
