Awards that include Federal and non -Federal sharing incorporate a budget consisting of <br />shared allowable costs If actual allowable costs are less than the total approved budget, <br />the Federal and non -Federal cost shares must be calculated by applying the approved <br />Federal and non -Federal cost share ratios to actual allowable costs. If actual allowable <br />costs exceed the total approved budget, the Federal share must not exceed the total <br />Federal dollar amount authorized by the award. <br />b. The non -Federal share, whether in cash or third -party in-kind contributions, is to be paid <br />out at the same general rate as the Federal share. Exceptions to this requirement may be <br />granted by the Grants Officer based on sufficient documentation demonstrating <br />previously determined plans for, or later commitment of, cash or third -party in-kind <br />contributions. In any case, the recipient must meet its cost share commitment as set forth <br />in the terms and conditions of the award; failure to do so may result in the assignment of <br />specific award conditions or other further action as specified in Standard Term A.06 <br />(Unsatisfactory Performance or Non -Compliance with Award Provisions). The non - <br />Federal entity must create and maintain sufficient records justifying all non -Federal <br />sharing requirements to facilitate questions and audits; see Section D of these Standard <br />Terms (Audits), for audit requirements. See 2 C.F.R. § 200.306 for additional <br />requirements regarding cost sharing. <br />4. Budget Changes and Transfer of Funds among Categories <br />a. Subrecipients are required to report deviations from the approved award budget and <br />request prior written approval from the Council and DOC in accordance with 2 C.F.R. § <br />200.308 (Revision of budget and program plans) and 2 C.F.R. § 200.407 (Prior written <br />approval (prior approval)). Requests for such budget changes must be submitted to the <br />Grants Officer (or electronically for awards serviced through Grants Online) who will <br />notify the recipient of the final determination in writing. Requests requiring prior DOC <br />approval do not become effective unless and until approved in writing by the DOC Grants <br />Officer. <br />b. In accordance with 2 C.F.R. § 200.308(1), transfers of funds by the recipient among direct <br />cost categories are permitted for awards in which the Federal share of the project is equal <br />to or less than the simplified acquisition threshold. For awards in which the Federal share <br />of the project exceeds the simplified acquisition threshold, transfers of funds among direct <br />cost categories must be approved in writing by the Grants Officer when the cumulative <br />amount of such direct costs transfers exceeds 10 percent of the total budget as last <br />approved by the Grants Officer. The 10 percent threshold applies to the total Federal and <br />non -Federal funds authorized by the Grants Officer at the time of the transfer request. <br />This is the accumulated amount of Federal funding obligated to date by the Grants Officer <br />along with any non -Federal share. The same requirements apply to the cumulative amount <br />of transfer of funds among programs, functions, and activities. This transfer authority <br />does not authorize the recipient to create new budget categories within an approved <br />budget without Grants Officer approval. Any transfer that causes any Federal <br />appropriation, or part thereof, to be used for an unauthorized purpose is not and will not <br />be permitted. In addition, this provision does not prohibit the recipient from requesting <br />Grants Officer approval for revisions to the budget. See 2 C.F.R. § 200.308 (Revision of <br />budget and program plans) (as applicable) for specific requirements concerning budget <br />revisions and transfer of funds between budget categories. <br />5. Program Income <br />Unless otherwise indicated in the award terms, program income may be used for any <br />required cost sharing or added to the project budget, consistent with 2 C.F.R. § 200.307 <br />Page 32 <br />
