SUTLER, CLERK <br />Contract# IRL2024N-08 <br />Encumbrance# GLO1-2309 <br />Federal entity or third persons resulting in death, bodily injury, property damages, or any <br />other losses resulting in any way from the performance of this award or any subaward, <br />contract, or subcontract under this award. <br />b. The acceptance of this award or any subaward by the non -Federal entity does not in any <br />way constitute an agency relationship between the United States and the non -Federal <br />entity or the non -Federal entity's contractors or subcontractors. <br />6. Unsatisfactory Performance or Non -Compliance with Award Provisions <br />a. Failure to perform the work in accordance with the terms of the award and maintain <br />satisfactory performance as determined by DOC may result in the imposition of additional <br />award conditions pursuant to 2 C.F.R. § 200.208 (Specific conditions) or other <br />appropriate enforcement action as specified in 2 C.F.R. § 200.339 (Remedies for <br />noncompliance). <br />b. Failure to comply with the provisions of an award will be considered grounds for <br />appropriate enforcement action pursuant to 2 C.F.R. § 200.339 (Remedies for <br />noncompliance), including but not limited to: the imposition of additional award <br />conditions in accordance with 2 C.F.R. § 200.208 (Specific conditions); temporarily <br />withholding award payments pending the correction of the deficiency; changing the <br />payment method to reimbursement only; the disallowance of award costs and the <br />establishment of an accounts receivable; wholly or partially suspending or terminating an <br />award; initiating suspension or debarment proceedings in accordance with 2 C.F.R. Parts <br />180 and 1326; and such other remedies as may be legally available. <br />c. 2 C.F.R. §§ 200.340 (Termination) through 200.343 (Effects of suspension and <br />termination) apply to an award that is terminated prior to the end of the period of <br />performance due to the non-federal entity's material failure to comply with the award <br />terms and conditions. In addition, the failure to comply with the provisions of a DOC <br />award may adversely impact the availability of funding under other active DOC or <br />Federal awards and may also have a negative impact on a non -Federal entity's eligibility <br />for future DOC or Federal awards. <br />B. FINANCIAL REQUIREMENTS <br />1. Financial Management <br />a. In accordance with 2 C.F.R. § 200.302(a) (Financial Management), each State must <br />expend and account for the Federal award in accordance with State laws and procedures <br />for expending and accounting for the State's own funds. In addition, the State's and any <br />other non -Federal entity's financial management systems, including records documenting <br />compliance with Federal statutes, regulations, and the terms and conditions of the Federal <br />award, must be sufficient to permit the preparation of reports required by general and <br />program -specific terms and conditions; and the tracing of funds to a level of expenditures <br />adequate to establish that such funds have been used in accordance with Federal statutes, <br />regulations, and the terms and conditions applicable to the Federal award. See also 2 <br />C.F.R. § 200.450 (Lobbying) for additional management requirements to verify that <br />Federal funds are not used for unallowable lobbying costs. <br />b. The financial management system of each non -Federal entity must provide all information <br />required by 2 C.F.R. § 200.302(b). See also 2 C.F.R. §§ 200.334 (Retention requirements <br />for records); 200.335 (Requests for transfer of records); 200.336 (Methods for collection, <br />transmission and storage of information); 200.337 (Access to records); and 200.338 <br />(Restrictions on public access to records). <br />2.
