dis <br />• <br />[7] <br />arbitration, and, at the OWNER's sole option, any and all arbitration arising out of or relating <br />to any of the Contract Documents or any breach thereof shall include by consolidation, <br />joinder, or joint filing any additional person or entity not a party to this Agreement to the <br />extent necessary for the final resolution of the matter in controversy. <br />( 16.8 At least one of the members of the arbitration panel must be an attorney licensed to practice <br />law in the State of Florida. <br />16.9 The surety shall be bound by the arbitration award to the same extent as the CONTRACTOR <br />is bound. <br />16.10 The arbitration panel shall submit a written opinion with findings of fact and conclusions o <br />law stating the basis for the decision made, and including an award of arbitration that may be <br />confirmed by a court of competent jurisdiction. <br />16.11 Unless OWNER agrees to the contrary, the location of any and all arbitration proceedings <br />shall be in the county in which the Project is located. <br />ARTICLE 17 - MISCELLANEOUS <br />i <br />Giving Notice: <br />17.1 Whenever any provision of the Contract Documents requires the giving of written notice, it <br />will be deemed to have been validly given if delivered in person to the individual or to a <br />member of the firm or to an officer of the corporation for whom it is intended, or if delivered <br />at or sent by registered or certified mail, postage prepaid, to the last business address known <br />to the giver of the notice. <br />Computation of Time: <br />17.2 When any period of time is referred to in the Contract Documents by days, it will be <br />computed to exclude the first and include the last day of such period, If the last day of any <br />such period falls on a Saturday or Sunday or on a day made a legal holiday by the law of the <br />applicable jurisdiction, such day will be omitted from the computation. <br />4 17.3 A calendar day of twenty-four (24) hours measured from midnight to the next midnight shall <br />constitute a day. <br />General: <br />�-' 17.4 Should OWNER or CONTRACTOR suffer injury or damage to person or property because <br />of any error, omission or act of the other party or of any of the other part's employees or <br />agents or others for a whose acts the otherparty is legally liable, claim will be made in writing <br />- to the other party within a reasonable time of the first observance of such injury or damage. <br />The provisions of this paragraph 17.4 shall not be construed as a substitute for or a waiver of <br />the provisions of any applicable statute of limitations or repose. <br />l_ <br />GENERAL, CONDITIONS <br />GC44 <br />
