4P <br />40 <br />similar to that provided in paragraph G.1 as applied by Engineer (and as may be <br />supplemented in the General Requirements). <br />5. Engineer will be allowed a reasonable time within which to evaluate each proposed <br />substitution. Engineer will be the sole judge of acceptability and shall have the right <br />to deny use of any proposed substitution. The CONTRACTOR shall not order, <br />install or utilize any substitution without either an executed Change Order or <br />Engineer's notation on the reviewed shop drawing. OWNER may require <br />CONTRACTOR to furnish at CONTRACTOR'S expense a special manufacturer's <br />performance guarantee(s) or other surety with respect to any substitute and an <br />r, indemnification by the CONTRACTOR. Engineer will record time required by <br />Engineer and Engineer's consultants in evaluating substitutions proposed by <br />CONTRACTOR and in making changes in the Contract Documents occasioned <br />thereby. Whether or not a proposed substitute is used, CONTRACTOR shall <br />reimburse OWNER for the charges of Engineer and Engineer's consultants for <br />evaluating each proposed substitute. <br />6. Substitute materials or equipment maybe proposed for acceptance in accordance with <br />these paragraphs (F.1 through F.6). In the event that substitute materials or equipment <br />are used and are less costly than the originally specified material or equipment, than <br />the net difference in cost shall benefit the OWNER and CONTRACTOR in equal <br />proportions. This cost difference shall not be reduced by any failure of the <br />CONTRACTOR to base his bid on the named materials or equipment. <br />F. Permits <br />1. As set forth in paragraph 6.15 of the GC, the OWNER has obtained the following <br />permit: <br />a) FDEP Permit No. IR -601 <br />2. The CONTRACTOR shall obtain and pay for all other required permits and licenses. <br />The CONTRACTOR shall provide copies of these permits to the OWNER and <br />Engineer and shall comply with all conditions contained in the permits at no extra cost <br />to the OWNER. <br />3. The CONTRACTOR shall be familiar with all permit requirements during <br />construction and shall be responsible for complying with these requirements. The cost <br />of this effort shall be included in the pay item which the work is most closely <br />associated with. <br />G. Tests and Inspections <br />(This paragraph supplements paragraphs 13.4 and 14.5 of the GC.) With regard to paragraph <br />13.4 of the GC, notice is hereby given that the OWNER may at any time during placement <br />of material extract samples for independent testing. All other tests required in the Contract <br />Document shall be provided by the CONTRACTOR. <br />SUPPLEM[-: NTARY CONDITIONS <br />SC 4 <br />
