40 <br />40 <br />40 <br />amount or type of damages, compensation or benefits payable by or for CONTRACTOR or <br />any such Subcontractor or other person or organization under worker's or workmen's <br />compensation acts, disability benefit acts or other employee benefit acts. <br />6.39 The obligations of CONTRACTOR under paragraphs 6.36 and 6.37 shall not extend to the <br />liability of ENGINEER, ENGINEER's consultants, agents or employees arising out of the <br />preparation or approval ofmaps, drawings, opinions, reports, surveys, Change Orders, designs <br />or specifications. <br />Interpretation of Contract Documents: <br />4 6.40 It is the duty of the CONTRACTOR to notify the ENGINEER, in writing, in the event of any <br />doubt or question as to the true meaning of any provision in the Contract Documents. The <br />ENGINEER's decision thereon shall be final. Annotated dimensions on drawings shall <br />I govern and work not dimensioned shall be as clarified by the ENGINEER. Work not <br />particularly shown or specified shall be the same as similar parts that are shown or specified. <br />Materials of work described in words which have a well-known technical or trade meaning <br />shall be deemed to refer to such recognized standard. <br />ARTICLE 7 - OTHER WORK <br />Related Work at Site: <br />7.1 OWNER may perform other work related to the Project at the site by OWNER's own forces, <br />have other work performed by utility owners or let other direct contracts therefor which shall <br />contain General Conditions similar to these. If the fact that such other work is to be <br />performed was not noted in the Contract Documents, written notice thereof will be given to <br />CONTRACTOR prior to starting any such other work; and, if CONTRACTOR believes that <br />such performance will involve additional expense to CONTRACTOR or required additional <br />time and the parties are unable to agree as to the extent thereof, CONTRACTOR may make <br />a claim therefor as provided in Articles 11 and 12. <br />7.2 CONTRACTOR shall afford each utility owner and other contractor who is a party to such <br />L_ a direct contract (or OWNER, if OWNER is performing the additional work with OWNER's <br />employees) proper and safe access to the site and a reasonable opportunity for the introduction <br />and storage of materials and equipment and the execution of such work, and shall properly <br />connect and coordinate the Work with theirs. CONTRACTOR shall do all cutting, fitting and <br />patching of the Work that may be required to make its several parts come together property <br />and integrate with such other work. CONTRACTOR shall not endanger any work of others <br />by others by cutting, excavating or otherwise altering their work and will only cut or alter <br />their work with the written consent of ENGINEER and the others whose work will be <br />affected. The duties and responsibilities of CONTRACTOR under this paragraph are for the <br />benefit of such utility owners and other contractors to the extent that there are comparable <br />provisions for the benefit of CONTRACTOR in said direct contracts between OWNER and <br />such utility owners and other contractors. <br />ARL <br />MML GENERAL COiii:UIONS <br />GC20 <br />
