Storage of PEP Reef Forms - License for Use of Road and Bridge <br />Complex - American Coastal En ineering <br />The Board reviewed a Memorandum of October 16, 1996: <br />TO: <br />James E. Chandler. <br />County Administrator <br />TITROUGIT: <br />James W. Davis. P.E.. <br />Public Works DIrecto <br />FROM: <br />Jeffrey R. Tabar. <br />Coastal Engineer J <br />SUBJECT: <br />License for Use of Road and Bridge Complex to Store <br />PEP Reef Forms <br />DATE: <br />October 16. 1996 <br />DESCRIPTION AND CONDITIONS <br />American Coastal Engineering (ACE) requested pennission to store ten PEP Reef <br />fonns at the Road and Bridge Complex. By storing the fonns in Vero Beach. the <br />costs associated with mobilization and fabrication of any future reef units for the <br />County will be greatly reduced. Staff requested American Coastal Engineering <br />provide insurance holding the County harmless of any claims. American <br />Engineering has agreed to all conditions placed by Indian River County and has <br />signed a license agreement with the County. The County Attorney's office has <br />rendered the opinion that as long as a public purpose exists. it is legal for the <br />County to store the forms of a private company. <br />RECOMMENDATIONS AND FUNDING <br />Staff requests the Board of County Commissioners approve the license agreement <br />by authorizing the Chainnan to execute the agreement. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Bird, the Board unanimously approved <br />execution of the license agreement with American <br />Coastal Engineering, as recommended in the <br />Memorandum. <br />LICENSE IS ON FILE IN THE OFFICE <br />OF THE CLERK TO THE BOARD <br />39 <br />November 5, 1996 <br />BOOK 99 f'AGE 5 1 56 <br />
