BOOK 99.. FAGS 573 <br />RESOLUTION NO. 96-134 <br />The conveyance of the land is made contingent and conditioned on the following: <br />1. Conveyance by Mr. Banack, of good and marketable title, free of any encumbrances <br />or liens, unto Indian River County, all that certain land in Indian River County, <br />Florida per attached deed; <br />2. Conveyance by Indian River County of good and marketable title, free r' <br />encumbrances or liens, of 61.7 feet lying Northerly of and adjacent to <br />Relief Canal right-of-way, per attached deed; <br />3. Signalization by Indian River County of the intersection of the road to <br />upon the real property conveyed hereby, "new Lundberg Road", and Kind <br />as soon as traffic volume warrants, to be designed in connection with pen& <br />of Lundberg Road and Kings Highway; <br />4. Indian River County's construction of a new Lundberg Road in conjunction wi, <br />Kings Highway at no expense to Mr. Banack within twenty-four (24) months from <br />date; <br />5. Following construction of the new Lundberg Road upon real property conveyed <br />hereby, right -turn in and right -turn out ingress and egress will be permitted to Mr. <br />Banack to and from his adjacent property onto 58th Avenue (Kings Highway). <br />Section 3 <br />The Board of County Commissioners authorize the chairman to execute all documents necessary to <br />effect the land exchange. <br />The foregoing resolution was offered by Commissioner Eggert , and Seconded <br />by Commissioner.
