BOOK 99 PAU 593 <br />6. Allowing car washes in the CL (Limited Commercial) zoning <br />district as a permitted use. _ <br />7. Codification of the adopted Wabasso Corridor Plan development <br />requirements. <br />The Planning and Zoning Commission (PZC) and the Professional <br />Services Advisory Committee (PSAC) have reviewed and made <br />recommendations on all the proposed amendments. To proceed with <br />the review and approval process for the amendments, the Board must <br />now set dates and times for the required public hearings. <br />ANALYSIS AND ALTERNATIVES: <br />Planning staff has coordinated closely with the county attorney's <br />office concerning the newer state requirements for LDR amendment <br />hearings. The new legislation divides LDR amendments into two <br />types: _ <br />1. Amendments which change the actual list of permitted, <br />conditional, or prohibited uses within a zoning category <br />(district); and <br />2. All other types of amendments. <br />One of the proposed amendments would change the zoning districts in <br />which car washes are allowed. Therefore, that amendment requires <br />two hearings. Florida statutes provides that one of those two <br />hearings can be held after 5:00 p.m., but that both hearings could <br />be held before 5:00 p.m. (e.g. regular Board meeting times) if that <br />option is approved by a majority plus 1 vote of the Board. Thus <br />with 4 or 5 positive votes, the Board could vote to hold both LDR <br />hearings before 5:00 p.m., such as at a regular Tuesday morning <br />Board meeting. All of the other amendments are required by the new <br />legislation to be considered at only one hearing, which could be <br />held before 5:00 p.m. <br />Two hearings will be required to be held in regard to the proposed <br />car wash amendment. In addition, staff notes that the Board may <br />desire some changes to the other proposed amendments. To <br />accommodate the legal requirements of the car wash proposal and to <br />accommodate any changes the Board may feel are needed for any of <br />the other amendments, it is staff's opinion that all of the LDR <br />amendments should be considered at two hearings. It is also <br />staff's opinion that the first hearing should be held after 5:00 <br />P.M. to accommgdate discussion and input from members of the public <br />for whom the 5:01 meeting time is more convenient. The second <br />hearing, which is generally shorter and more of a "wrap-up" <br />meeting, could be held during a regular Tuesday morning Board <br />meeting. <br />One set of hearing dates which would comply with state hearing and <br />advertizing requirements, would allow for two hearings for all <br />proposed amendments, and appears to accommodate the Thanksgiving <br />Holiday and Commissioners schedules, is as follows: <br />Hearing Date Time <br />1. Special meeting Wednesday, December 4, 1996 5:01 P.M. <br />2. Regular meeting Tuesday, December 17, 1996 9:05 a.m. <br />Staff has tentatively reserved use of the Commission Chambers for <br />these proposed dates.
