He <br />noted that five of the speakers today were from the Baptist <br />denomination; however, the Board is not authorized and should not <br />regulate on the basis of protecting -one denomination over another. <br />He recalled that at the workshop other denominations' <br />representatives were not concerned about reducing the separation <br />distance. <br />Attorney Barkett summed up that Ms. Fothergill owns a <br />restaurant and wants to serve beer and wine and not one instance <br />had been mentioned today of a situation of this type of <br />establishment creating a conflict with a church or with a school or <br />with the community. The impact of a restaurant on a community is <br />much different than the impact of a bar or a lounge and that is <br />what has to be considered. Ms. Fothergill's restaurant is located <br />in a commercial district which should have commercial enterprises <br />such as restaurants. He pointed out that restaurants pay taxes and <br />taxes help this community. He stated that no valid planning, <br />zoning, or police power concerns were brought up as to why a <br />restaurant in a commercial zoning district should, pot be, allowed <br />within 500 feet of a church. In spite of all the emotion, 'he <br />believed that is where the Board should focus. <br />Greg Smith, executive director of facilities for Indian River <br />County School District, wished to clarify his statements from the <br />October 11th meeting referred to by Mr. Barkett. He advised that <br />at the school district they did not want the school children to see <br />the consumption of alcohol, the advertisements associated with bars <br />or restaurants that serve alcohol, nor did they want anyone who has <br />consumed alcohol (wherever it might have been consumed) to stumble <br />across a school campus. He added that he was attempting to support <br />the Sheriff's position at that meeting in their effort to maintain <br />control in the community. <br />Commissioner Macht moved to direct staff not to do anything to <br />reduce the separation any further; motion died for lack of a <br />second. <br />Commissioner Eggert thought there was an inconsistency and <br />would like to see if staff can determine a difference between <br />"restaurant" and "bar" that will stick. <br />81 <br />November 5, 1996 <br />903 99 WAGE 598 <br />
