After several questions from the Commissioners regarding the <br />bidding amount, County Attorney Vitunac advised that the Board <br />would be obligated to the minimum bid advertised. <br />Commissioner Bird wanted to know what would be the advantage <br />of having the contract signed in advance. <br />Karlin Daniel advised the Board that the advantage would be <br />that the auctioneer would be able to enter into a bilateral <br />contract with the buyer. The issue is the urgency and certainty of <br />the sale. Should the contract be returned to the Board for <br />execution, the buyer would have some time in which to renege on the <br />bid made at auction. <br />Commissioner Macht questioned when the escrow monies would be <br />collected, and Mr. Daniel stated that funds would be collected <br />immediately upon signing the contract. However, at any time prior <br />to acceptance by the seller, the buyer can back out of the <br />contract. A cashier's check is required at the moment the buyer is <br />declared the highest bidder. The conditions of the auction require <br />10% down, which goes into an escrow account. <br />County Attorney Vitunac recommended that the Board sign the <br />contract. <br />ON MOTION by Commissioner Macht, SECONDED by <br />Commissioner Eggert, the Board unanimously approved <br />the contract with Karlin Daniel & Associates, Inc. <br />and authorized the Chairman to execute the contracts <br />in blank for the highest bid at or over the minimum, <br />as recommended by staff. <br />CONTRACT WILL BE ON FILE IN THE OFFICE OF THE <br />CLERK TO THE BOARD WHEN EXECUTED AND RECEIVED <br />GENERAL COMMENTS BY COMMISSIONER BIRD <br />Commissioner Bird thanked the Board and staff for their <br />remembrance of his birthday and the other honors involved in his <br />retirement from the Board. It was all very moving and meant a <br />great deal to him.
