BOOK <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Bird, the Board unanimously approved <br />the developer's agreement with Hammock Lakes <br />Associates, Ltd. for the construction of Offsite <br />Utilities (Wastewater and Water) for Hammock Lakes <br />Subdivision, as recommended by staff. <br />AGREEMENT IS ON FILE IN THE OFFICE OF THE <br />CLERK TO THE BOARD <br />99 PAU 781 <br />AUCTION OF OLD COUNTY COURTHOUSE - KARLIN DANIEL <br />CONTRACT <br />The Board reviewed a Memorandum of November 7, 1996: <br />TO: Board of County Commissioners <br />FROM: Terrence P. O'Brien, Assistant County Attorney <br />DATE: November 7, 1996 <br />SUBJECT: AUCTION OF COUNTY COURTHOUSE <br />The Board of County Commissioners at its regular meeting of November <br />5, 1996 approved the contract with Karlin Daniel Auctioneers for the <br />auction of the courthouse. <br />The contract provides in pertinent part that "The real estate listed <br />herein is being sold on a(n) reserve basis." In staff's memorandum to <br />the Commission dated October 4, 1996 on this subject which was <br />considered by the Board at its regular meeting of October 22, 1996 the <br />term "reserve" was explained as follows: "The reserve format is when <br />the seller sets the price range and retains the right to accept or reject <br />the top bid." <br />Karlin Daniel has now suggested that the Commission may want to <br />authorize the Chairman to execute the contracts in blank in advance of <br />the auction. Karlin Daniel would hold them in escrow and will itse them <br />if the bidding exceeds the minimum reservation amount. This will allow <br />the contract to be fully executed at the time of auction sale which may <br />be to the County's advantage. It would, however, remove the right for <br />the Commission to accept or reject the highest bid. This may not be n <br />detriment because all bids to be acceptable would have to be over the <br />minimum amount set by the Commission which is $150,000.00 for the <br />Courthouse and $125,000.00 for the State Attorney Building. <br />In view of the foregoing, it is our understanding that the Commission is <br />willing to accept the minimum prices and therefore it should authorize <br />the Chairman to execute the contracts in blank for the highest bid at <br />or over the minimum. <br />A copy of the proposed contract for sale is attached. <br />Assistant County Attorney Terry O'Brien advised that Karlin <br />Daniel has suggested that the Board sign a blank contract.
