in the amount of $500 per day shall be assessed until SWDD determines the issues have <br />been resolved. <br />f) Site Maintenance. If the Contractor fails to properly conduct site maintenance and <br />groundskeeping activities in the manner and frequency as required in this Contract, <br />SWDD shall provide notice to the Contractor. If the Contractor fails to remedy the issues <br />within twenty-four (24) hours of notice from SWDD, Administrative Charges in the <br />amount of $500 per day shall be assessed until SWDD determines the issues have been <br />resolved. <br />g) Reports & Deliverables. If the Contractor fails to provide any reports or deliverables to <br />SWDD within the time frame specified in this Agreement or any Amendment to this <br />Agreement, SWDD shall assess Administrative Charges in the amount of $500 per day <br />that each report and/or deliverable is late. <br />h) Failure to Open, Close or Properly Secure CCCs. If Contractor fails to open the CCCs on- <br />time or close the CCCs on time or properly secure one of the CCCs at the end of a day's <br />operation, SWDD shall assess Administrative Charges in the amount of $1,000 per <br />occurrence. <br />i) Loss of Use Due to Negligence. If through Contractor negligence, including negligence by <br />one of its employees, an operation covered under this Contract becomes unavailable for <br />use by the citizens of Indian River County, the payment to the Contractor will be reduced <br />by the number of days the operation is unavailable, and Administrative Charges of $500 <br />per day will be assessed by SWDD. <br />j) Other Related Charges: <br />1. Commingling solid waste with recyclable materials: $200 per occurrence per location. <br />2. Failure to prevent out -of -county waste or Recyclables from being accepted at CCCs: <br />$500.00 per occurrence. <br />3. Failure to properly cover/contain materials in collection vehicles: $200.00 per <br />occurrence. <br />4. Failure to display the Contractor's name and phone number on collection vehicles: <br />$100.00 per occurrence per day. <br />5. Delivery of waste to the Indian River County Landfill that did not originate at the <br />CCCs: $1,000 for the first offense, $5,000 for the second offense, and Potential loss <br />of Contract for the third offense. <br />12.2.4 If any violation or deficiency is repeated within forty-eight (48) hours, after an initial <br />deficiency is identified in the same category, the violation will be considered a <br />continuation of the original deficiency and Administrative Charges will be immediately <br />assessed. <br />ACTIVE: 38438749. 1 <br />19 <br />
