3. The Contractor shall be responsible for verifying and initialing all scale house tickets to <br />confirm that the customer has been issued a ticket, that the load is at the correct <br />unloading location as indicated on the ticket and agrees that the load is acceptable. <br />4. The Contractor shall refuse to accept any unauthorized waste delivered to the Site that is <br />revealed by inspection of a load. If any unauthorized waste is delivered in any load, the <br />Contractor shall immediately stop the customer from unloading of the waste. The <br />Contractor shall then notify SWDD and request SWDD to inspect the load. SWDD shall <br />make the final determination as to whether the load is unauthorized for acceptance based <br />on federal, state, and local regulations. <br />5. If the Contractor finds unauthorized waste in a load of waste and the customer is still in <br />possession of the load, the Contractor shall immediately notify SWDD so that SWDD can <br />follow up with the customer on the proper handling and disposal method for the <br />unauthorized waste. <br />6.. If the Contractor finds unauthorized waste in a load of waste and the customer is no <br />longer in possession of the load, then the Contractor is responsible for properly disposing <br />of the waste according to federal, state, and local regulations or policies at the <br />Contractor's expense. If the Contractor determines who the generator of the waste is, the <br />Contractor may seek recovery for the expenses incurred. <br />4.4 Capital Expenditures <br />Contractor understands that any capital expenditure that the firm makes, or prepares to make, <br />to perform the services required by the County, is a business risk that the Contractor must assume. <br />SWDD will not be obligated to reimburse amortized or unamortized capital expenditure or to <br />maintain the approved status of any Contractor. If the Contractor has been unable to recoup its <br />capital expenditures during the time it is rendering such services, it shall not have any claim upon <br />the County. <br />Article 5. Personnel <br />5.1 General Personnel Provisions <br />5.1.1 Contractor shall be responsible for providing resources to carry out the work specified <br />herein. Contractor shall maintain at all times a work force of adequate size and skill to fully <br />and successfully perform all required services. <br />5.1.2 Contractor shall have one (1) person assigned as a landfill superintendent, responsible for <br />direct oversight of the Class I Landfill Operations at the Landfill, one (1) person assigned as <br />a Landfill foreperson, and one (1) person assigned as a supervisor responsible for direct <br />oversight of the HHW, SLD area, and other Ancillary areas' activities as outlined in this <br />Agreement. In the absence of a primary supervisor, the Contractor will designate an <br />alternate supervisor and provide notification to SWDD. At a minimum, all designated <br />supervisors at the Landfill, shall be trained as a Florida Certified Spotter and hold a current <br />HAZWOPER 40 -hour Certification. All vehicle operators shall maintain a valid Florida State <br />Commercial Driver's License (CDL).
