Article 12. Insurance <br />12.1 Contractor shall not commence work until all the insurance required under this section has been <br />obtained, and until such insurance has been approved by SWDD. Firm's insurance shall be <br />primary. The County shall be named as an additional insured for both General Liability and <br />Automobile Liability. The awarded firm shall maintain the following limits of insurance during the <br />term duration of this agreement. <br />• Owners and Subcontractors Insurance: The Contractor shall not commence work until they have <br />obtained all the insurance required under this section, and until such insurance has been <br />approved by the owner, nor shall the contractor allow any subcontractor to commence work until <br />the subcontractor has obtained the insurance required for a contractor herein and such insurance <br />has been approved unless the subcontractor's work is covered by the protections afforded by the <br />Contractor's insurance. <br />• Worker's Compensation Insurance: The Contractor shall procure and maintain worker's <br />compensation insurance to the extent required by law for all their employees to be engaged in <br />work under this Agreement. In case any employees are to be engaged in hazardous work under <br />this Agreement and are not protected under the worker's compensation statute, the Contractor <br />shall provide adequate coverage for the protection of such employees. <br />• Public Liability Insurance: The Contractor shall procure and maintain broad form commercial <br />general liability insurance (including contractual coverage) and commercial automobile liability <br />insurance in amounts not less than shown below. The owner shall be an additional named insured <br />on this insurance with respect to all claims arising out of the operations or work to be performed. <br />Commercial General <br />Commercial General (Public) Liability, A. Contractual Liability <br />for Bodily Injury and Property Damage F. Explosion, Collapse, and Underground <br />Property Damage <br />Commercial General Liability Insurance including, but not limited to, Independent Contractor, <br />Contractual, Premises/Operations, Products/Completed Operation and Personal Injury <br />covering the liability assumed under indemnification provisions of this Agreement, with limits <br />of liability for personal injury and/or bodily injury, including death, of not less than <br />$3,000,000.00, each occurrence; and property damage of not less than $3,000,000.00, each <br />occurrence. (Combined single limits of not less than $3,000,000.00, each occurrence —general <br />aggregate; $3,000,000.00 — products -comprehensive or aggregate; $3,000,000.00 —each <br />occurrence, will be acceptable unless otherwise stated). Coverage shall be on an "occurrence" <br />basis, and the policy shall include Broad Form Property Damage coverage and Fire Legal <br />Liability of not less than $3,000,000.00 per occurrence, unless otherwise stated by exception <br />herein. <br />Indian River County Landfill Operating Agreement Final Page 28 of 42 <br />
