A TRUE COPY <br />CERTIFICATION ON LAST PAGE <br />RYAN L. BUTLER, CLERK <br />STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION <br />ROAD JURISDICTION TRANSFER (RJT) AGREEMENT <br />logistical and operational limitations of the DEPARTMENT, certain responsibilities will be <br />delegated to local entities as follows: <br />Responsibilities of the DEPARTMENT: In addition to the roadbed, this Agreement <br />includes all curbs, guardrails, barrier walls, sidewalks, bicycle paths, culverts/pipes, <br />drainage/control structures, pavement markings, streetlights (including those on <br />bridge structures), traffic control devices (including traffic signal equipment), traffic <br />monitoring sites (including data collection for traffic counts, as described below), and <br />mowing (when standard landscaping is present), within the right-of-way at the time of <br />transfer. <br />a. The COUNTY may supplement maintenance responsibilities of the <br />DEPARTMENT as needed to maintain roadway functionality. <br />2. The DEPARTMENT will retain responsibility for maintenance of roadway segments <br />along CR -510 (90th Avenue/85th Street) that have reached construction completion <br />prior to the effective date of transfer. Construction completion shall be defined as the <br />mutual written agreement of the COUNTY and the DEPARTMENT by letter of <br />construction completion that the projects have been built in accordance with the <br />design plans and specifications, which are incorporated herein by reference <br />(collectively, the "Plans and Specifications"). Following construction completion, <br />temporary maintenance responsibilities for the DEPARTMENT shall be defined by <br />separate and subsequent MMOAs with the COUNTY until such time that the transfer <br />ON to the State Highway System is effective upon DEPARTMENT issuance of the <br />Right -of -Way Certification for project FM No. 441692.1. The maintenance agreements <br />shall include temporary provisions for operation and maintenance of stormwater <br />detention areas and bridges/structures built as part of the construction project. <br />3. The DEPARTMENT accepts all responsibility for and will operate and maintain the <br />existing stormwater detention areas listed below, and as depicted on Exhibit F-1 and <br />F-2, that serve the subject roadway segments of CR -512 (Sebastian Boulevard) and <br />CR -606 (Oslo Road), respectively: <br />a. Pond A, located along the north side of CR -512 (Sebastian Boulevard), just west <br />of 102nd Avenue/102nd Terrace. <br />b. Pond B, located along the north side of CR -512 (Sebastian Boulevard), just west <br />of WW Ranch Road. <br />c. Pond C, located along the north side of CR -512 (Sebastian Boulevard), just east <br />of the eastern entrance driveway to Sebastian River Middle School. <br />d. Pond 100 (Phase 2), located to the north of CR -606 (Oslo Road), along the east <br />side of CR -611 (43rd Avenue SW) near the intersection with 6th Place SW. <br />e. Pond 200 (Phase 2), located to the north of CR -606 (Oslo Road), just west of CR - <br />612 (27th Avenue SW) along the south side of 7th Street SW. <br />f. Pond 500 (Phase 1), located along the north side of CR -606 (Oslo Road), just east <br />of the southern entrance driveway to Bradford Place. <br />g.
