A TRUE COPY <br />STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION CERTIFICATION ON LAST PAGE <br />ROAD JURISDICTION TRANSFER (RJT) AGREEMENIRYAN L. BUTLER, CLERK <br />By Resolution No. dated , 20 , attached hereto as Exhibit C-2 and <br />by this reference made a part hereof, the COUNTY expresses its intention to transfer the <br />maintenance obligations and duties for at -grade railroad crossing #272168, located within <br />the transfer limits of CR -510 (85th Street), and #272200, located within the transfer limits <br />of CR -606 (Oslo Road), to the DEPARTMENT. These transfers will occur separately once <br />the DEPARTMENT enters into a separate Railroad Crossing Agreement with Florida East <br />Coast (FEC) Railway, L.L.C. The DEPARTMENT may agree to assume all maintenance <br />responsibilities for the railroad crossings, including relevant traffic control devices, in <br />accordance with the terms of the new Railroad Crossing Agreement. Until such time as <br />the new agreement is negotiated and signed, the COUNTY will continue to maintain the <br />railroad crossings in accordance with the existing Railroad Crossing Agreement. <br />J. The DEPARTMENT agrees to perform all activities necessary to keep the roadways fully <br />and properly functioning at all times. Activities include overseeing maintenance duties <br />assigned to others and enforcing maintenance agreements as necessary. The <br />DEPARTMENT and the COUNTY will amend, revise, or create new agreements as <br />necessary to ensure ongoing maintenance and preserve roadway functionality. <br />It is agreed that all obligations of the COUNTY, under any maintenance, utility, <br />railroad, or other such agreement relating to any specific road to be transferred, shall <br />be transferred at the same time and in the same manner as jurisdictional <br />responsibility. If the agreements were made between the parties to this transfer, and <br />the transferring party will no longer be involved after the transfer takes place, or an <br />applicable agreement does not exist, new agreements or amended agreements shall <br />be made in accordance with the provisions described below. The COUNTY <br />acknowledges that copies of any existing permits, agreements, and easements have <br />been turned over to the receiving entity for their records prior to the execution of this <br />Agreement. <br />2. Maintenance Agreements <br />a. For immediate transfers: The DEPARTMENT and the COUNTY are amending the <br />existing Traffic Signal Maintenance and Compensation Agreement and the <br />existing State Highway Lighting, Maintenance, and Compensation Agreement <br />prior to the transfer to assign responsibility for the maintenance of existing traffic <br />control devices and existing streetlights within the right-of-way. The amended <br />tables are attached hereto as Exhibit G-1 and G-2, respectively. <br />b. For the future transfer of CR -510 (90th Avenue/85th Street), subject to the <br />DEPARTMENT's issuance of Right -of -Way Certification for project FM No. <br />441692.1: The DEPARTMENT and the COUNTY will amend the Traffic Signal <br />Maintenance and Compensation Agreement and the State Highway Lighting, <br />Maintenance, and Compensation Agreement prior to the transfers to assign <br />responsibility for the maintenance of existing traffic control devices and existing <br />streetlights within the right-of-way, including any fixtures added through roadway <br />construction. <br />c. The DEPARTMENT and the COUNTY will draft or amend, as necessary and when <br />appropriate, any additional agreements not specified herein within a reasonable <br />timeframe following the effective date of transfer for each roadway corridor, <br />Road Jurisdiction Transfer (RJT) Agreement — Page 17 <br />
