BUTLER, CLERK <br />ROAD JURISDICTON TRANSFER (RJT) AGREEMENT <br />including both immediate and future transfers. <br />K. Transfer of the roadway corridor rights-of-way from the COUNTY to the DEPARTMENT <br />shall be by right-of-way map transfer ("Map Transfer") or title deed. The method of <br />conveyance for CR -512 (Sebastian Boulevard), CR -510 (90th Avenue/85th Street) and <br />CR -606 (Oslo Road) shall be determined based on the specific requirements of the <br />transaction and in accordance with legal standards for property transfers. For immediate <br />transfers, The COUNTY shall deliver the Map Transfer or title deed to the DEPARTMENT <br />within ninety (90) days following the Execution Date of this Agreement. The Execution <br />Date is the date which the Department's Secretary executes this Agreement. For future <br />transfers, the COUNTY shall deliver the Map Transfer or title deed to the DEPARTMENT <br />within ninety (90) days following DEPARTMENT issuance of Right -of -Way Certification <br />for project FM No. 441692.1 The DEPARTMENT shall record the Map Transfer or title <br />deed, at no cost to the COUNTY, in the public land records of Indian River County within <br />one -hundred eighty (180) days of its receipt and ensure property appraiser records are <br />updated to accurately reflect this transfer. The DEPARTMENT shall provide the COUNTY <br />with a copy of the recorded conveyance document within thirty (30) days of receipt of the <br />same from the recording office. Once the Map Transfer or title deed is recorded, <br />undefined conveyances, including but not limited to easements, will be pursued within a <br />reasonable timeframe. <br />The Map Transfer and other conveyances for this Agreement shall be consistent with <br />the future right-of-way needs for the active or planned DEPARTMENT Work Program <br />projects listed in Section I.D. <br />L. Any work by others requiring a permit for CR -512 (Sebastian Boulevard), CR -510 (90th <br />Avenue/85th Street) and CR -606 (Oslo Road) shall be permitted by both the COUNTY <br />and the DEPARTMENT until such time that the respective transfer of each roadway <br />corridor ON to the State Highway System has been recorded in the public land records <br />of Indian River County. The COUNTY shall notify all permittee applicants that a dual <br />permit by the DEPARTMENT is required prior to any work being executed. <br />II. In general: <br />A. The DEPARTMENT conducted a public hearing in conjunction with the Indian River <br />County Board of County Commissioners meeting on , 2025. <br />Documentation attached, hereto as Exhibit D. <br />B. The terms of this Agreement are summarized in Exhibit B-2. In case of a discrepancy <br />between this Agreement and Exhibit B-2, this Agreement shall prevail. <br />C. All words used herein in the singular form shall extend to and include the plural. All words <br />used in the plural form shall extend to and include the singular. All words used in any <br />gender shall extend to and include all genders. <br />D. This Agreement embodies the whole agreement of the parties. There are no promises, <br />terms, conditions, or obligations other than those contained herein, and this Agreement <br />shall supersede all previous communications, representations, or agreements, either <br />verbal or written, between the parties hereto. <br />Road Jurisdiction Transfer (RJT) Agreement — Page 18 <br />
