1.3.3 The Design -Builder will visit the Project site, become familiar with the local conditions, <br />and correlate observable conditions with the requirements of the Owner's Project, schedule, and <br />budget. <br />1.3.4 The Design -Builder will review laws applicable to design and construction of the Project, <br />correlate such laws with the Owner's Project requirements and advise the Owner if any Project <br />requirement may cause a violation of such laws. Necessary changes to the Owner's Project will <br />be accomplished by appropriate written modification or disclosed as described in Paragraph <br />1.3.6. The Design -Builder shall not be liable for violation of any laws caused by the directions of <br />the Owner and is not responsible for providing legal services and interpretations to the Owner. <br />1.3.5 The Design -Builder will review with the Owner alternative approaches to design and <br />construction of the Project. <br />1.3.6 The Design -Builder will submit to the Owner for Owner's approval, the Design -Builder's <br />plan for the competitive process the Design -Builder will use in obtaining subcontractor bids for <br />the development of the GMP Proposal. The plan will include, but not be limited to, , bid submittal <br />dates, analysis process of bids after receipt, subcontractors bid sheets by bid packages, and the <br />determination of bids to be included in the GMP proposal. <br />1.3.7 The Design -Builder will submit to the Owner a GMP Proposal, including the final design <br />documents, a statement of the proposed guaranteed maximum price and a proposed <br />guaranteed completion date of the Project. Final design documents will consist of final <br />construction design drawings, specifications or other documents sufficient to establish the size, <br />quality and character of the entire Project including its architectural, structural, mechanical and <br />electrical systems, and materials and such other elements of the Project as may be appropriate. <br />Deviations from the Owner's Project will be disclosed and expressly highlighted in the GMP <br />Proposal. If the GMP Proposal is accepted by the Owner, the parties will then execute the Part 2 <br />Contract. Notwithstanding anything herein to the contrary, Owner reserves the absolute right, in <br />its sole discretion, to reject the GMP Proposal and not execute the Part 2 Contract for any or no <br />reason whatsoever, or to terminate this Contract in accordance with Article 8. In such event, all <br />final design documents, including all Project Documents (as defined in Paragraph 3.1), will <br />become the property of the Owner and Owner will be entitled to retain and use all such Project <br />Documents as set forth in Paragraphs 3.1 and 8.5 herein. <br />1.4 ADDITIONAL SERVICES <br />1.4.1 The Additional Services described below will be provided by the Design -Builder and paid <br />for by the Owner if authorized and confirmed in writing by the Owner. <br />1.4.1.1 Making revisions in the final design documents, budget or other documents when such <br />revisions are not the result of the fault or neglect of the Design -Builder or anyone for whom the <br />Design -Builder is responsible and are: <br />1.4.1.1.1 Inconsistent with approvals or instructions previously given by the Owner, including <br />substantial revisions made necessary by adjustments in the Owner's Project or Project budget; <br />1.4.1.1.2 Due to substantial changes required as a result of the Owner's failure to render <br />decisions in a timely manner. <br />Ixora Park Infrastructure Improvements 4 <br />
