BOOK : 96 PATE 682 <br />approved site plan that covers the mall and adjacent areas. Since <br />necessary improvements have been approved through and are <br />controlled by the site plan process, no subdivision improvements <br />are required. The use of the prcpoced lots will be tied to <br />improvements completed with the mall development. No certificates <br />of occupancy (C.O.) will be issued for buildings on the proposed <br />lots until the improvements necessary to serve the lot(s) have been <br />completed, inspected, and approved through normal site plan <br />procedures. <br />All applicable requirements regarding final plat approval have been <br />satisfied. Pursuant to the local developer's agreement executed <br />last spring by DeBartolo and the county, the developer is required <br />to warrant utility improvements via a Bill of Sale, prior to the <br />issuance of a C.O. for the mall. The utilities within the limits <br />of the plat are the only improvements being publicly dedicated. <br />Therefore, no -guarantees of publicly dedicated improvements are <br />required at this time. <br />RECOMMENDATION: <br />Based on the above analysis, staff recommends that the Board of <br />County Commissioners grant final plat approval for the Indian River <br />Mall West Peripheral Subdivision. <br />ON MOTION by Commissioner Adams, SECONDED by <br />Commissioner Bird, the Board by a 4-0 vote <br />(Commissioner Eggert being absent) unanimously <br />approved the final plat for Indian River Mall West <br />Peripheral Subdivision, as recommended by staff. <br />H.
