Board of County Commissioners Meeting Minutes - Final November 4, 2025 <br />(AWIA) Risk and Resilience Assessment and Emergency Response Plan Update <br />Services. Ms. Sapp stated that the Emergency Response Plan (ERP) aligned with <br />Local, State, and Federal standards. She explained that staff had updated and <br />expanded the ERP and the Rapid Response Guide (Guide), a concise document <br />that highlighted the critical information staff needed in an emergency. The Guide <br />addressed the most significant hazards identified in AWIA, ensuring that Utility <br />Services were prepared to respond effectively. It outlined the necessary <br />resources, roles, and responsibilities for recovery and coordination with <br />Emergency Services. <br />There was no further discussion on the Item. <br />A motion was made by Vice Chairman Loar, seconded by Commissioner <br />Adams, to accept the America's Water Infrastructure Act (AWIA) Risk and <br />Resilience Assessment and Emergency Response Plan Update. The motion <br />carried by the following vote: <br />Aye: 5 - Chairman Flescher, Vice Chairman Loar, Commissioner Adams, Commissioner <br />Earman, and Commissioner Moss <br />14. COUNTY ATTORNEY MATTERS <br />14.A. 25-1044 Culverted Road Crossing Maintenance Agreement with Vero West <br />Business Park <br />Attachments: Kenilworth Plat- PB6 PG43 <br />Aerial for Culvert Acess Agreement <br />Culverted Road Crossing Maintenance Agreement - Vero West <br />Business Park.pdf <br />Deputy County Attorney Susan Prado discussed the 30 -foot -wide drainage canal <br />right-of-way that had been established by the Kenilworth Estates Plat, which Vero <br />West Business Park, LLC sought to develop. To access the property, a culverted <br />road was needed to cross the right-of-way, and a maintenance agreement had been <br />prepared between the County and the Vero West Business Park Property Owners' <br />Association (POA). The agreement held the POA responsible for maintaining the <br />culvert and road crossing, relieving the County of any obligations. Before finalizing the <br />plat, clarifications on payment and maintenance responsibilities were necessary. The <br />agreement would be recorded in public records to ensure clear responsibilities for the <br />POA regarding the culvert and road crossing. <br />Ms. Prado informed Commissioner Moss that an internal road was currently in place, <br />primarily connecting two private parcels owned by the applicant. This road did not <br />facilitate any external traffic. <br />A motion was made by Vice Chairman Loar, seconded by Chairman Flescher, to <br />approve staffs recommendation.
