DESCRIPTION AND CONDITIONS: <br />Houston Cuozzo Group, Inc., on behalf of American Tower Systems, <br />has submitted an application requesting site plan administrative <br />approval and special exception use approval to construct an <br />unmanned 300' self -supported communications tower and associated <br />equipment building. The subject tower site is to be located at <br />12280 83rd Street, approximately 2 miles south of CR 512, west of <br />I-95 (see attachment #2). The proposed tower site is a .92 acre <br />lease area in the northern third of an overall 6.32 acre site. In <br />the southeast corner of the overall site, an existing single family <br />dwelling is occupied by the lessor. Because the proposed tower <br />exceeds 140' in height, and because the site is located within an <br />A-1 zoning district, special exception use approval must be granted <br />for construction of the tower. <br />At its regular meeting of October 24, 1996, the Planning and Zoning <br />Commission, by vote of 5 to 0, recommended that the Board grant <br />special exception use approval with the conditions stated in the <br />recommendation section of this report (see attachment #4). On <br />November 5, 1996, the Board adopted a six month moratorium on <br />applications for communications towers such as the one proposed <br />with this application. However, the moratorium specifically <br />excluded complete applications in process as of November 5, 1996. <br />This is such an application. Therefore, this application is not <br />affected by the moratorium and is to be const e5 <br />the <br />The Board is now to approve, approve with conditions, or deny the <br />special exception use request. Pursuant to Section 971.05 of the <br />LDRs, the Board of County Commissioners is to consider the <br />appropriateness of the requested use for the subject site and its <br />impact on surrounding properties. The County may attach any <br />conditions and safeguards necessary to mitigate impacts and to <br />ensure compatibility of the use with the surrounding area. <br />Staff has reviewed the submitted proposal and has granted site plan <br />administrative approval subject to the Board granting special <br />exception use approval and any conditions attached to that <br />approval. Therefore, the administrative site plan approval will <br />become effective if and when the Board grants special exception use <br />approval. <br />ANALYSIS: <br />• General Land Development Regulations <br />1.
