13. Utilities: The proposed site is outside of the utilities <br />service area. Given the type of use, no water or wastewater <br />services are required. Therefore, county utilities has no <br />objection to approval of the site plan and use request. <br />14. Health & Rehabilitative Services (HRS): The HRS Environmental <br />Health Unit acknowledges that the site will not require a <br />potable water supply or sanitary facility, and has no <br />objections to approval of the site plan and use request. <br />• Special Exception Use Criteria <br />15. Specific Land Use Criteria: The applicant must satisfy the <br />following specific land use criteria which apply to the <br />erection of a tower exceeding 140' in height within an A-1 <br />zoning district. <br />A. General criteria for all towers exceeding 70' in height. <br />1. All towers not related to amateur radio <br />communications use shall have setbacks from all <br />property lines equal to one hundred ten (110) <br />percent of the height of the proposed structure. <br />This setback provision may be waived or modified if <br />the applicant submits a certified, signed and <br />sealed statement from a Florida registered <br />professional engineer stating that the tower would <br />collapse within the designed and specified fall <br />radius depicted on the plans. <br />Towers related to amateur radio communication use <br />need only satisfy building setbacks for the zoning <br />district in which the tower is located. This less <br />stringent setback provision is in recognition of <br />the FCC's PRB-1 preemption for amateur radio <br />communications. <br />2. In cases where the tower is not related to amateur <br />radio communications use, the fall radius (one <br />hundred ten (110) percent of the tower height or <br />other approved design fall radius) shall not <br />encroach upon existing off-site structures or <br />adjacent residentially designated property; <br />Note: The project engineer for the tower has <br />provided a general description of the tower design, <br />and has stated the tower is designed to fall within <br />the radius of the guy wires, which is 100(see <br />attachment #5). <br />The tower is set back 134' from the nearest <br />property line, and approximately 350' from the on- <br />site residence occupied by the lessor. Pursuant to <br />the specific land use criteria, the tower's fall <br />radius (1001) is contained on the subject site and <br />does not encroach upon existing structures. <br />3. The distance of any guy anchorage or similar device <br />shall be at least five (5) feet from any property <br />line; <br />4. All accessory structures shall be subject to the <br />height restrictions provided in Accessory uses, <br />Chapter 917; <br />21 <br />DECEMBER 3, 1996 <br />
