I <br />Boa 99 i,nE1023 <br />County planning staff has coordinated with interested parties, <br />including School District staff. At its November 19, 1996 meeting <br />the School District voted to recommend that the Board of County <br />Commissioners not change the alcoholic beverage ordinance (see <br />attachment #5). According to School District staff, the District's <br />concerns relate to District schools only (elementary and secondary <br />schools). The proposed ordinance change should not affect District <br />schools, since only post -secondary types of schools would be <br />affected. <br />Staff is currently mapping locations of bars, restaurants and clubs <br />that are licensed to serve alcoholic beverages. That information <br />is being added to existing map information on church, school, <br />zoning district locations. Maps showing all this information will <br />be distributed to the Board and interested parties prior to the <br />December 3rd meeting. <br />RECOMMENDATION: <br />Staff recommends that the Board authorize staff to advertise the <br />proposed ordinance for adoption. <br />Planning Director Stan Boling advised that this is the third <br />time the Board has looked at this proposed change to the County's <br />alcoholic beverage ordinance. The purpose of this meeting is for <br />staff to get further direction from the Board on preparing a final <br />ordinance which would be county -wide. Using the ELMO overhead <br />projection system, he showed a map the Board had requested at the <br />last meeting showing the locations of existing bars and restaurants <br />in commercial and industrial districts. At present, County <br />ordinances state that a bar or a restaurant serving alcohol, <br />located in commercial or industrial districts, must be 1000 ft. <br />away from a church or school. <br />Chairman Adams opened the meeting to public discussion. <br />Chris Taylor, pastor of Antioch Primitive Baptist Church, <br />felt it was unfair that the proposed ordinance treats schools and <br />churches differently. In fact, they believe it may be <br />unconstitutional and they have contacted a legal action group to <br />research the matter.
