r -1 <br />ion <br />DESCRIPTION AND CONDITIONS: <br />Knight, McGuire & Associates, Inc. has submitted an application for <br />conceptual PD plan and special exception use approval on behalf of <br />Idlewylde Corp. Inc. to construct a single phase, 109 lot detached <br />single family PD to be known as The Sanctuary. In addition to the <br />conceptual PD plan and special exception use request, the applicant <br />is also requesting preliminary PD plan approval (site plan and <br />preliminary plat) for the project. <br />The subject property is located on the north side of 33rd Street <br />approximately } mile west of 58th Avenue (see attachment #2). The <br />property has 990' of frontage on 33rd Street and is zoned RS -3, <br />Residential Single Family (up to 3 units per acre). <br />•PD Project Process <br />As a PD project, the process involved in review and approval of <br />this proposal is as follows: <br />Approval Needed Reviewing Bod <br />1. Conceptual Plan/Special Exception PZC & BCC <br />2. Preliminary PD Plan PZC <br />3. Land Development Permits or Waiver Staff <br />4. Final PD Plat BCC <br />The applicant is now requesting approval of the first two steps. <br />If approved by the Board of County Commissioners, the applicant <br />will need to obtain a land development permit for the required PD <br />infrastructure improvements. <br />•Board of County Commissioners Consideration <br />Pursuant to Section 971.05 of the LDRs, the Board of County <br />Commissioners is to consider the appropriateness of the requested <br />conceptual PD plan based on the submitted PD plan and suitability <br />of the site for that use. The Board may approve, approve with <br />conditions, or deny the special -exception use. The County may <br />attach any conditions and safeguards necessary to mitigate impacts <br />and to ensure compatibility of the use with the surrounding area. <br />If the Board of County Commissioners approves the special exception <br />use, it would also be granting the applicant's appeal of the <br />preliminary PD plan/plat denial. <br />•Planning and Zoning Commission Action <br />At its November 26, 1996 meeting, the Planning and Zoning <br />Commission voted unanimously (6-0) to: <br />• Deny the preliminary planned development plan/plat submitted, <br />and <br />• Recommend that the Board of County Commissioners deny the <br />special exception use request. <br />The Planning and Zoning Commission based its decision on general <br />compatibility issues. Please see the minutes of the Planning and <br />Zoning Commission meeting (attachment #4), and item #18 under the <br />"ANALYSIS" section of this report. The Board is now to act on the <br />special exception use, conceptual plan, and preliminary PD plan <br />requests. <br />ANALYSIS: <br />1. Size of Development: <br />37.55 acres gross <br />37.07 acres net (less future right-of-way for 33rd Street) <br />2. Zoning: RS -3, Residential Single Family (up to 3 units per <br />acre) <br />3.
