_I <br />environmental planning staff prior to the issuance of the land <br />development permit. <br />Since the excavation of the lake will involve the removal of <br />more than 5,000 cubic yards of excavated material from the <br />site, the provisions of Chapter 934 mining regulations apply. <br />The developer is intending to excavate and haul from. the site <br />approximately 27,000 cubic yards. This excavation and hauling <br />activity is considered incidental to project construction. <br />Prior to issuance of a land development permit, the developer <br />must apply for and obtain a mining permit exemption from <br />staff. It is staff's understanding that the developer intends <br />to request a mining permit exemption. In order to qualify for <br />a mining permit exemption, the developer must demonstrate to <br />environmental planning staff, through the land development <br />permit review process, that all of the criteria of section <br />934.04(7)(b) are satisfied. <br />Since the subject site is, for the most part, surrounded by <br />active citrus groves, staff advised the applicant and Planning <br />and Zoning Commission that some ornamental/exotic house and <br />yard plants typically planted in residential developments may <br />be Caribbean Fruit Fly host plants. Such plants should be <br />avoided in areas near citrus groves to ensure marketability of <br />the citrus. In response to staff's advisory comment, the <br />Planning and Zoning Commission voted to add a condition of <br />approval that would require the developer to include in the <br />subdivision covenants a deed restriction on the planting of <br />such host plants. In addition, a prohibition of the plants <br />should be included in the Board's action, as was done with the <br />Trails End PD project. Such a prohibition will give the <br />county the ability to enforce the prohibition via code <br />enforcement action, if necessary. Therefore, the deed <br />restriction requirement and a prohibition are contained in <br />staff's recommendation at the end of this report. <br />14. Required Improvements: For projects in the RS -3 zoning <br />district, bikeway, sidewalk, and streetlight improvements may <br />be required pursuant to section 911.07(6) of the LDRs. For <br />this project: <br />a. A bikepath is required along the development's 4th Street <br />frontage by the provisions of the county's _Bikeway and <br />Sidewalk Plan. Although not depicted on the plan, a <br />bikepath must be provided by the applicant. <br />b. Sidewalks are not required along the development's 4th <br />street frontage by the provisions of the county's Bikeway <br />and Sidewalk Plan. <br />C. Internal sidewalks are not required, since the project's <br />overall density does not exceed 3 units per acre <br />(reference section 913.079(5)(b)3.b. of the LDRs). <br />d. Streetlighting is a required improvement which must be <br />provided. The applicant has agreed to provide <br />streetlighting in a manner which will illuminate the <br />project's entrance road intersection with 4th Street. <br />The property owners association will own and maintain all <br />streetlighting improvements. These streetlighting <br />provisions will be incorporated into the project's land <br />development permit. <br />15. Dedications: The applicant intends to dedicate subdivision <br />improvements, via the final plat, as follows: <br />a. Internal Stormwater Easements and Tracts: Private/ <br />Property Owners Association <br />b. Utility Easements: Public/Indian River County <br />C. Street and Right -of -Way: Public/Indian River County <br />16. Concurrency Management: Long-range planning staff ha4 <br />indicated that a conditional concurrency certificate will be <br />issued for the project prior to the Planning and Zoning <br />Commission consideration of this item. Thus, all concurrency <br />requirements related to the preliminary plat approval have <br />been satisfied. <br />DECEMBER 17, 1996 52 <br />
