Approval Needed Reviewing Body <br />1. Conceptual Plan/Special Exception PZC & BCC <br />2. Preliminary PD Plan PZC <br />3. Land Development Permits or Waiver Staff <br />4. Final PD Plat BCC <br />The applicant is now requesting approval of the first step. If <br />approved by the Board of County Commissioners, the applicant will <br />then need to apply for and obtain preliminary PD plan approval from <br />the Planning and Zoning Commission in order to proceed with the <br />project. <br />•Board of County Commissioners Consideration <br />Pursuant to Section 971.05 of the LDRs, the Board of County <br />Commissioners is to consider the appropriateness of the requested <br />conceptual PD plan based on the submitted PD plan and suitability <br />of the site for that use. The Board may approve, approve with <br />conditions, or deny the special exception use. The County may <br />attach any conditions and safeguards necessary to mitigate impacts <br />and to ensure compatibility of the use with the surrounding area. <br />*Planning and Zoning Commission Action <br />At its January 9, 1997 meeting, the Planning and Zoning Commission <br />voted (6-1) to recommend that the Board of County Commissioners <br />grant conceptual plan and special exception planned development <br />approval with conditions. The Planning and Zoning Commission <br />included in its recommendation 4 new conditions and modifications <br />to two of the 7 conditions originally recommended to the Commission <br />by staff. These conditions and the applicant's responses are <br />discussed in -detail in item #19 of the analysis section. <br />ANALYSIS: <br />1. Size of Development: 42.55 Acres <br />Net Size After Indian River <br />Boulevard Right -of -Way Dedication: 42.17 acres <br />2. Zoning Classifications: <br />27.05 acres: RM -10, Residential Multi -Family (up to 10 <br />units/acre) <br />15.5 acres: RS -11 Residential Single Family (up to 1 <br />unit/acre) <br />3. Land Use Designations: <br />27.05 acres: M-2, Medium Density Residential 2 (up to 10 <br />units/acre) <br />15.5 acres: C-2, Conservation 2 (up to 1 unit/40 acres or 1 <br />unit/acre transferrable density) <br />4. Phasing: The proposed development is to be constructed in two <br />phases, with 144 units in the first phase and 160 units in the <br />second phase. Each phase will contain a lake, pool, and <br />clubhouse facility. The first phase is located on the western <br />portion of the site adjacent to Indian River Boulevard.
