CHASTAIN <br />MANAGER OF ASSESSMENT PROJECTS <br />SUBJECT: INDIAN RIVER COUNTY <br />DEPARTMENT OF UTILITY SERVICES <br />SUMMARY OF ASSESSMENT PROJECT PROCEDURES <br />SUMMARY OF ASSESSMENT PROJECT PROCEDURES <br />Indian River County Ordinance No. 92-28 (copy attached) contains <br />procedures by which the Board of County Commissioners may provide <br />for local services or improvements on a special assessment basis by <br />its own initiative or upon petition by owners to be benefitted <br />thereby. The ordinance encompasses: requirements and form of <br />petitions, publication and adoption of the services or <br />improvements, preliminary assessment roll and hearing, notice to <br />the owners, final assessment roll, payment of assessments, <br />assessments to become liens, and providing authority to borrow <br />funds. <br />Services and improvements include: streets and roads, water and <br />sewage systems, water and sewage treatment plants, drainage, street <br />lighting, sidewalks, and such other services or facilities which <br />may be deemed essential. <br />The procedure authorized by the Board of County Commissioners for <br />the Department of Utility Services is (although not limited to) the <br />square foot method of assessment of properties. This is the only <br />method of assessment which has been upheld by the Florida Supreme <br />Court. <br />Staff in the Department of Utility Services have performed <br />extensive evaluations of alternative assessment methods. on June <br />14, 1991 in a special meeting before the Board of County <br />Commissioners, staff reviewed these results and presented examples <br />of same (the meeting was covered by the news media). The minutes <br />of the meeting and the discussion regarding special assessments <br />follow. <br />A State statute mandated the adoption of a Comprehensive Plan, <br />which Indian River County adopted in 1990. The Comprehensive Plan <br />requirements set forth in Objective 2 of the Water Sub -Element <br />require the installation of water facilities to serve the urban <br />service areas, giving priority to subdivisions having undersized <br />lots and/or health problems.
