property was submitted to the FCT for 50% funding in lieu of County <br />efforts to obtain cost -share funding from the St. Johns River Water <br />Management District (SJRWMD), based on indications that SJRWMD is <br />reluctant to commit to 50% funding of river -front lands which <br />include relatively expensive uplands (vs. wetlands). <br />Funding Approved <br />On December 3, 1996, the FCT Governing Body held a public hearing <br />in Tallahassee regarding seventh -year -cycle FCT grant applications. <br />The purpose of the hearing was to finalize the scoring and ranking <br />of each submitted project. Out of 62 applications submitted state- <br />wide, the Round Island South and the St. Sebastian PUD properties <br />ranked 6th and 11th (respectively), and as a result were approved <br />to receive cost -share funding. <br />Conceptual Approval Agreement <br />Since the December 3rd FCT hearing, FCT staff has visited the <br />subject properties with county staff to verify site conditions as <br />represented in the project application. In accordance with. State <br />procedures, the next step is for the FCT Governing Body and the <br />County Commission to execute a "Conceptual Approval Agreement" for <br />each of the two projects. Because the St. Sebastian PUD property <br />is located within the City of Sebastian, the City Council must also <br />execute that agreement for full approval. <br />ANALYSIS <br />The agreements consist largely of standard language and conditions <br />pursuant to Rule 9K-4, Florida Administrative Code, the rule which <br />sets forth Florida Communities Trust program procedures. <br />The agreements consist of eight main sections, as follows <br />(paraphrased): <br />I. General Conditions <br />II. Requirements Prior to Initiation of Negotiations <br />III. Project Plan Approval <br />IV. Project Site Acquisition Requirements <br />V. Obligations as a Condition of Project Funding <br />VI. Obligations Relating to Use of Bond Proceeds <br />VII. Disallowable Activities/Remedies <br />VIII. Site Specific Management Plan Conditions <br />The General Conditions section of the agreement contains standard <br />language pertaining to timing and coordination of steps between the <br />County and FCT, and among other things identifies the key contact <br />from the County for purposes of coordinating project activities. <br />Requirements Prior to Initiation of Negotiations outlines a number <br />of steps and time frames including the requirement that the County <br />identify and authorize a representative of the County to execute <br />all FCT documents relating to the acquisition. This section also <br />includes reference to a required Confidentiality Agreement (Exhibit <br />"B" attached), which must include the names and signatures of local <br />representatives who will be privy to confidential appraisals during <br />the negotiation process. <br />Under this section of the agreement, the County has the opportunity <br />to choose whether the County or FCT will be the responsible party <br />for all negotiation and acquisition activities.
