might be a good idea for Mr. Glynn I s group to fix up the park right <br />now and that we require the new group to start from snuff and bear <br />the liability from that point on. She would like to see some kind <br />of transfer of liability from the first group to the second group. <br />Mr. Glynn felt that would be difficult since they have to put <br />in gates, landscaping, etc. <br />Commissioner Adams believed the best way to handle this is for <br />both groups to sit down with staff, and County Attorney Vitunac and <br />Administrator Chandler, and work something out which would be a <br />win, win situation for everybody. <br />Chairman Eggert just felt that the park could be better kept <br />than what it is now. She would like us to take some step to at <br />least improve the situation out there even with all that is going <br />on. For whatever reason, it doesn't seem to be happening. We need <br />to do something that will make it look better and will give staff <br />something to work with, even if it is not 100% done. We need to <br />have money put in escrow to cover anything else that needs to be <br />done. Commissioner Adams pointed out that Wabasso Beach Park is <br />the most heavily used park in the county. <br />ON MOTION by Commissioner Adams, SECONDED by <br />Commissioner Ginn, the Board approved the existing <br />height on the existing Summerplace seawall and <br />tabled the remainder until February 25 to allow time <br />to meet with affected parties and come back with a <br />recommendation on liability and time schedules. <br />Update on South Beach Seawalls <br />Director Davis reported that the construction of the seawall <br />for the Papin and Bunger properties has not started yet. <br />Apparently, the contractors have ordered materials and hope to get <br />started soon. However, we are getting very close to the sea turtle <br />nesting season. <br />Director Davis reported that we have issued a stop order on <br />the Gerstner seawall that was granted an emergency permit at the <br />BCC meeting of December 17, 1996. The seawall has been placed <br />seaward of the permitted location, as much as 20 feet. The permit <br />stated that it would be 15 feet from the swimming pool, but now it <br />is about 35 feet from the swimming pool. Mrs. Gerstner claims she <br />did not get a copy of the permitted drawing from her attorney or <br />her engineer.
