However, we have not seen anything in writing from the DEP <br />about the height of the wall. <br />Commissioner Adams was concerned that we don't have anything <br />in writing from the DEP and whether we would have an up and down <br />effect in the seawalls due to the requirement that the height is <br />predicated on the height of the dune at that point. <br />Director Davis advised that we are still waiting for more <br />information from the additional 6 homes, but he anticipated a more <br />consistent height in the seawalls in the south county. <br />County Attorney Vitunac stated that the County's emergency <br />permit does not interfere with any private property right. When <br />somebody asks for a permit, they must have the authority over their <br />own land, including the easements that go to the beach. <br />William Glynn, one of the owners of a residence protected by <br />the seawall that was given an emergency permit in April, 1996 <br />explained that the owners of the first 8 homes are part of the <br />Summerplace Improvement Association, which is a deed restricted <br />home owners association that owns its own streets and maintains its <br />own area. Immediately to the north of that, there is another area <br />that was platted as Summerplace, but they are not part of the home <br />owners association. They are just good friends and neighbors. <br />Chairman Eggert asked if the contracts for repairs to the <br />Wabasso Beach Park property have been finalized. She understood <br />there have been several unsigned documents going back and forth, <br />and cautioned that we have to make sure that we are working with <br />the right people in the appropriate group. <br />Director Davis confirmed that there have been a few documents. <br />One document was transmitted back to us by Mr. Glynn agreeing to <br />some conditions for replacement of the sand that the County had <br />deposited in the park and restoring the park area. After <br />conferring with the County Attorney's office, there was a feeling <br />that we had to further memorialize some of the commitments in <br />writing. Those documents were sent. The intent is to make sure <br />that we have good restoration of the park and protect County <br />property if there are any adverse impacts from the seawall because <br />our park land is immediately south of the Summerplace seawall. <br />Chairman Eggert understood that all of that is held liability <br />free, and Director Davis indicated that was correct. <br />Mr. Glynn believed that the Wabasso Beach Park will be needed <br />to stage the construction for the seawall extension, but Chairman <br />Eggert stated that would be worked out by Director Davis, <br />Administrator Chandler and Attorney Vitunac.
