County Attorney Vitunac addressed Commissioner Adams' concerns <br />as to how the proposed ordinance was structured and advised that it <br />was not legally necessary to reiterate the Statute in the County's <br />ordinance. <br />Commissioner Ginn asked when the Board would receive copies of <br />the Statute, and County Attorney Vitunac advised that he had copies <br />of the booklet mentioned in the proposed ordinance and he would be <br />happy to provide her with one. <br />MOTION WAS MADE by Commissioner Adams, SECONDED BY <br />Commissioner Ginn, to approve staff's recommendation <br />as set forth in the memorandum. <br />Under discussion, Commissioner Macht suggested the public <br />hearing be scheduled instead for the 18th of March as a civic <br />association member wishes to be present to speak and will need time <br />to see the booklet and be able to prepare. <br />MOTION WAS AMENDED by Commissioner Adams and <br />Commissioner Ginn to hold the public hearing on <br />March 18th, 1997. THE CHAIRMAN CALLED THE QUESTION <br />and the amended motion carried unanimously. <br />H. Consent to R -O -W Easement over Utility Easement - Willie Lawson, <br />Grantor of Easement for Ingress and Egress <br />The Board reviewed a Memorandum of February 6, 1997: <br />TO: Board of County Commissioners <br />FROM: Charles P: Vitunac, County Attorney <br />DATE: February 6,1997 <br />RE: CONSENT TO RIGHT-OF-WAY EASEMENT <br />OVER UTILITY EASEMENT <br />Indian River County has a utility easement over some local property owned by <br />the Lawsons, and in connection with the sale of the property it is necessary to <br />give a right-of-way easement which crosses the County's utilities easement. The <br />parties involved have requested that the County execute a consent to granting a <br />right-of-way easement over the County's utility easement. The County has no <br />objection to doing so, provided that the County's right to its utility easement is <br />superior to the right-of-way easement. The attached document accomplishes <br />that. <br />REQUESTED ACTION: Staff recommends that the Chairman of the Board of <br />County Commissioners execute the attached consent to easement. <br />15 <br />February 18, 1997 BOOK �� <br />
