Proposed Amendment to Code of Ethics and Conduct Ordinance <br />The Board reviewed a Memorandum of February 5, 1997 and the <br />proposed amendment: <br />TO: Board of County Commissioners <br />FROM: Terrence P. O Brien, Assistant County Attorn eyo <br />DATE: February 5, 1997 <br />SUBJECT: CODE OF ETHICS AND CONDUCT <br />The Board of County Commission at its regular meeting of January 21, 1997 <br />directed staff to amend the subject code. A proposed amendment is attached <br />for consideration and a public hearing. A date of March 11, 1997 is suggested <br />for the public hearing. <br />Section 104.06. Code of ethics and conduct. <br />(1) The code of ethics and conduct for commissioners, county employees <br />and Board members shall be as contained in the Florida Statutes, in particular <br />Chapter 112. <br />(2) It shall be the duty of each commissioner, board member, board <br />appointed county employee, department head and professional staff' member to <br />become familiar with the code o f ethics for public officers and employees. To <br />this end, the personnel director shall distribute to each person in the above <br />enumerated categories a current copy of the "Florida Commission on Ethics <br />Guide to the Sunshine Amendment and Code of Ethics for Public Officers and <br />Employees." <br />(3) If a person has a question as to whether a certain set of facts could give <br />rise to an ethics question or -possible violation, the opinion of the Commission <br />on Ethics should be sought by that person, This may be done in the following <br />way: <br />(1) By writing to the Commission giving all the facts and asking for a <br />formal opinion, <br />(2) By writing to the staff of the Commission giving all the facts and <br />asking for a staff opinion, <br />(3) By calling the Commission and giving the facts to a staff attorney. <br />If there is an existing opinion covering the facts presented, the staff attorney <br />will orally respond to the inquiry.
