BOOK "10,0 PAGE I;. <br />DESCRIPTION AND CONDITIONS: <br />On December 14, 1995, the Planning and Zoning Commission granted <br />major site plan approval (with conditions) to construct a 30,752 <br />square foot multi -tenant warehouse facility. The subject site is <br />located at 3863 39th Square on lots 1, 2, and 3 of the Gateway <br />Center Phase I Commercial Subdivision. The expiration date of the <br />site plan approval was December 14, 1996. <br />Prior to the site plan expiration date, the project applicant filed <br />a building permit application. Due to delays in project funding, <br />the applicant also requested an extension of the site plan approval <br />expiration date. Although the request was made prior to the <br />December expiration, staff held off processing the request until <br />the applicant was sure that he would build the project. The <br />applicant now indicates that the project is ready to be built. <br />Pursuant to site plan regulations, the request may now be <br />considered by the Board of County Commissioners. <br />ANALYSIS: <br />Although the LDRs have been amended since the time of project <br />review and approval, the members of the Technical Review Committee <br />(TRC) concur that subsequent amendments as appliod to the subject <br />project would not require any revisions or redesign of the project. <br />All TRC staff members recently approved the applicant's request for <br />site plan extension. <br />As allowed under the provisions of the LDRs, the applicant is <br />requesting a full one year extension of the site plan approval <br />expiration date. Pursuant to Chapter 914 of the LDRs, the Board of <br />County Commissioners may deny, approve, or approve with additional <br />conditions the requested site plan extension. Staff has no <br />objections to the Board granting the request, since the previously <br />approved site plan substantially conforms to existing LDR <br />requirements. <br />RECOMMENDATION• <br />Staff recommends that the Board of County Commissioners approve the <br />applicant's request for a one year extension of the conditional <br />site plan approval, with all original site plan approval conditions <br />to remain in effect. The new site plan approval expiration date <br />will be December 14, 1997. <br />ON MOTION by Commissioner Adams, SECONDED by <br />Commissioner Tippin, the Board by a 4-0 vote <br />(Commissioner Macht being absent) approved a one <br />year extension of the conditional site plan <br />approval, with all original site plan approval <br />conditions to remain in effect, to expire December <br />14, 1997, as recommended by staff. <br />MARCH 41 1997 <br />14 <br />
