IS <br />THROUGH:- Stan Boling, AICP <br />Planning Director <br />FROM: Eric Blad I3 <br />Staff Planner, Current Development <br />DATE: February 26, 1997 <br />SUBJECT: Peter Sabonjohn Is Request for Final Plat Approval for Oak <br />Terrace Subdivision Unit 1 <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of March 4, 1997. <br />DESCRIPTION AND CONDITIONS: <br />On June 23, 1988, the Planning and Zoning Commission approved the <br />proposed preliminary plat for Oak Terrace Subdivision, a multi - <br />phased subdivision located in the south county between the Oak <br />Ridge and Dixie Heights subdivisions. Unit 1 of the subdivision is <br />a 12 lot phase of the overall 43 lot project that is bordered by <br />the Lateral "J" Canal to the west and Oak Ridge Unit 2 Subdivision <br />to the north. The submitted final plat is consistent with the <br />approved preliminary plat. Through a series of land development <br />permit extensions granted by the Board, the applicant has <br />maintained valid subdivision construction permits. The applicant <br />has now completed construction and has submitted for final plat <br />approval for Oak Terrace Unit 1 Subdivision. <br />The owner, Peter Sabonjohn, is now requesting final plat approval <br />for Unit 1 and has submitted the following: <br />1. A final plat in conformance with the approved preliminary <br />plat; <br />2. A certificate of completion for Oak Terrace Unit 1 <br />construction. <br />3. A warranty/maintenance agreement to guarantee performance of <br />publicly dedicated road and drainage improvements. <br />ANALYSIS: <br />With the exception of streetlighting, all required subdivision <br />improvements have been completed, and a certificate of completion <br />has been issued by public works. Via an agreement between the <br />developer and FP&L, streetlighting is guaranteed and will be <br />provided by FP&L. Because a certificate of completion has been <br />issued, the developer has executed a warranty/maintenance <br />agreement, and installation of streetlighting is ensured, staff has <br />no objection to final plat approval. <br />All applicable requirements regarding final plat approval have been <br />satisfied. Pursuant to the county's LDRs, the applicant will be <br />required to post security to guarantee the warranty/maintenance <br />agreement prior to recording the -final plat. <br />MARCH 49 1997 17 BOOK 1-01J, <br />
