RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners declare said structures a nuisance, and <br />order the buildings demolished with related debris removed from the property by a private vendor <br />approved through standard bid procedures. <br />Staff further recommends that the Board adopt the attached resolution authorizing the Building <br />Official to report the county's demolition and debris removal cost for each structure to the county <br />attorney for the preparation and recording of alien to be placed on the real property of the owner of <br />each demolished unsafe structure for the purpose of recovering the county's costs. <br />Building Division Director Ester Rymer advised the Board that <br />she would like to give Dorothy Collier an additional 45 days to <br />make substantial improvements to her property. She would also like <br />the Board to grant her the discretion to allow Ruth Williams and <br />Roosevelt Banks and Carrie Copeland the opportunity to demolish <br />their respective properties themselves. <br />ON MOTION by Commissioner Adams, SECONDED by <br />Commissioner Ginn, the Board by a 4-0 vote <br />(Commissioner Macht being absent) adopted Resolution <br />97-015 providing for the demolition of unsafe <br />structures and the recovery of costs (Dorothy <br />Collier, Blackburn & Williams, Elijah Griff, Ruth <br />Williams, Roosevelt Banks and Carrie Copeland, Inez <br />Rievers Workman); while giving the Building Official <br />discretion to allow Ruth Williams and Roosevelt <br />Banks and Carrie Copeland the discretion to demolish <br />their properties themselves and authorizing the <br />Building Official to grant Dorothy Collier 45 <br />additional days to make substantial improvements. <br />RESOLUTION NO. 97- 1,; <br />A RESOLUTION OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, <br />FLORIDA, PROVIDING FOR THE DEMOLITION OF <br />UNSAFE STRUCTURES AND THE RECOVERY OF <br />COSTS. <br />WHEREAS, Indian River County has adopted the Standard Unsafe <br />Buildings Abatement Code (SUBAC), 1985 Edition (at Section 401.01, Indian <br />River County Code); and " <br />WHEREAS, Section 701 of the Standard Unsafe Buildings <br />Abatement Code provides for the recovery of the costs of repairs to and/or <br />demolitions of unsafe structures by policies and procedures established by the <br />local governing body; and <br />WHEREAS, Section 100.080 of the Indian River County Code <br />provides that the Board of County Commissioners may cause, by resolution, a <br />lien to be filed in the Official Record Books of the County against the owner of <br />property or person responsible for compliance with the Code for the costs <br />incurred by the County; and <br />BOOK 100 PAGE"733 <br />3 <br />MARCH 49 1997 21 <br />
