BOOK <br />An Agreement was pending between the County and the Contractor in which a request <br />was made by the Contractor to meet with County staff. A meeting was conducted on Feb. <br />19, 1997 with the following individuals: <br />James W. Davis, P.E., Public Works Director <br />Jeffrey R. Taber, Coastal Engineer <br />Jim Romanek, Parks Maintenance Supervisor <br />Bill Glynn, Summerplace S/D (Phase I Rep.) <br />Charlie Cangianelli, Congianelli Const. (Contractor) <br />Brenda Parvus, Summerplace SID (Phase 11 Rep.) <br />Vince Bruno, Summerplace SID (Phase II Rep.) <br />ALTERNATIVES AND ANALYSIS <br />During the above meeting several items were discussed concerning the use of Wabasso <br />Beach Park. It was agreed upon that the park would be returned to its original or better <br />condition by June 1, 1997. This responsibility will be divided up and subject to the <br />following conditions: <br />1) Cangianelli Construction Co. will be responsible for 100% of the cost of materials <br />and labor to complete the clean-up. <br />2) Summerplace Improvement Association, Inc. will join with the additional six <br />contiguous homes immediately to the north of Summerplace Unit 2, Block C, Lot #7 <br />to guarantee Cangianelli's performance using the following formula: S.I.A., Inc. shall <br />guarantee 4/7th's of the cost of a clean-up default by Cangianelli... The six <br />adjacent, contiguous homes to the north of the deed restricted area, shall guarantee <br />3/7th's of the cost. <br />3) Said guarantee shall expire on June 1, 1997 and the Summerplace Improvement <br />Association, Inc. shall be released of all responsibility for the clean-up of the <br />Wabasso Beach parking lot after that date. <br />4) The clean-up shall consist of a replacement of the metal gate allowing access to the <br />beach ramp, removal of the beach ramp, replacement of any sand used by <br />Cangianelli Construction. Inc., a grading of the north side of the Wabasso Beach <br />parking lot. and the installation of landscaping mutually acceptable to Cangianelli <br />and the County. <br />5) In the event that the above six (6) properties, approved on Jan. 28, 1997, are <br />unable to complete their seawall construction by June 1, 1997 they will be required <br />to provide a written request to the County for use of the park following the 1997 <br />turtle nesting season. The County then shall require a written agreement be signed <br />by the owners before such use of the park is authorized. <br />6) Upon request of written notice that the work and obligations are completed and <br />ready for final inspection and acceptance, the County will promptly arrange for <br />inspections. <br />7) The Contractor will not store materials on the park site and may only use the park <br />for ingress/egress over the dune during the construction activity. Over the Easter <br />weekend, no equipment shall be parked on the park property. The Contractor shall <br />provide adequate sea turtle protection on the Park site. <br />RECOMMENDATIONS AND FUNDING <br />Staff has reviewed the above conditions and requests that the contractor be given <br />approval to continue to use the park for the remainder of the time necessary to complete <br />the seawall. <br />NO FACES <br />Public Works Director Jim Davis stated that the contractor <br />will restore the dune prior to June 1st. Construction activity <br />will continue during March and April until turtle nesting activity <br />picks up when they will remove their equipment and restore the <br />dune. This will resolve the commitment from the original 8 <br />owners. Then next year the contractor will come back and request <br />permission to again use the park to finish the seawall to the <br />north. Staff has received complaints that the contractor is <br />MARCH 4, 1997 36 <br />
