Baldwin and Others' Request to Amend the <br />Comprehensive Plan to Redesignate Approximately 4.6 acres <br />from M-1 to C/I, and to Rezone Approzimately 7 acres from <br />RS -6, RM -6 and CL to Ca <br />PLAN AMENDMENT NUMBER: LIIDA 96-07-0203 <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their regular <br />meeting of March 18, 1997. <br />DESCRIPTION AND CONDITIONS <br />This request involves both a land use designation amendment and a <br />rezoning. The land use designation amendment involves changing the <br />land use designation of 4.6 acres from M-1, Medium -Density. <br />Residential -1 (up to 8 units/acre), to C/I, Commercial/Industrial <br />Node. Located on the north side of SR 60, at 63rd Court, that land <br />consists of lots 1-10 of the 12 -lot Wallace Acres subdivision. <br />The retoning request, totaling 7 acres, involves the entire Wallace <br />Acres subdivision, as well as the adjacent tract to the west. <br />Those 7 acres presently are within the following zoning districts: <br />-6, Single -Family Residential <br />Lots 3 Through 10 <br />strict (up to 6 units/acre) <br />-6, Multiple -Family Residential <br />[District <br />Lots 1 and 2 <br />(up to 6 units/acre) <br />, Limited Commercial District <br />Lots it and 12, and the <br />Tract to the West <br />The request is to rezone the entire seven acre subject property to <br />CG, General Commercial District. The purpose of this request is to <br />secure the necessary land use designation and zoning to develop the <br />property with commercial uses. <br />On September 26, 1996, the Planning and Zoning Commission voted 6-0 <br />to recommend that the Board of County Commissioners transmit the <br />proposed land use amendment to the State Department of Community <br />Affairs (DCA) for their review. <br />On November 21, 1996, the Board of County Commissioners voted 5-0 <br />to transmit the proposed land use amendment request to DCA for <br />their review. The Board of County Commissioners is now to decide <br />whether or not to adopt the requested land use designation and <br />zoning district. <br />ORC Report <br />Consistent with state regulations, DCA reviewed the proposed <br />amendment and prepared an Objections, Recommendations and Comments <br />(ORC) Report (dated January 30, 1997), which planning staff <br />received on February 4, 1997. The DCA ORC Report (attachment 7) <br />contained one objection to this proposed.amendment. That objection <br />was procedural in nature and related to the county's state mandated <br />Evaluation and Appraisal Report (EAR). <br />According to state law, the county was required <br />adopted EAR to DCA by January 1, 1997.
