government's adopted EAR submittal date has passed, state law <br />prohibits that local government from amending its comprehensive <br />plan until DCA has determined that the EAR is sufficient. On <br />February 24, 1997, DCA determined that the county's EAR was <br />sufficient. <br />Between the county's January 1, 1997 EAR submittal date and DCA's <br />February 24, 1997 sufficiency determination, the county was <br />prohibited from amending its comprehensive plan. Because the DCA <br />ORC Report was issued on January 30, 1997, prior to DCA's EAR <br />sufficiency determination (February 24, 1997), the ORC Report <br />contained an objection based on the county's EAR not having been <br />determined to be sufficient [Section 163.3187(6), F.S. and Rule 9J - <br />5.0053(4)(e), F.A.C.]. The analysis section of this staff report <br />contains a response to DCA's objection. <br />Existing Land Use Pattern <br />The Wallace Acres subdivision contains 8 single-family houses. The <br />tract to the west is zoned CL and contains the "Bill's TV" store. <br />Land to the north, east and west of the subject property is zoned <br />CG and consists of the Indian River Mall and its commercial <br />outparcels. South of the subject property, across SR 60, laud is <br />zoned RS -6 and contains single-family homes. <br />Future Land Use Pattern <br />Lots 1-10 of the Wallace Acres subdivision, as well as land ttj <br />south, across SR 60, are designated M-1, Medium-Dernity <br />Residential -1, on the county future land use map. The M-1. <br />designation permits residential uses with densities up to 8 units/ <br />acre. Lots 11 and 12 of the subdivision, as well as the tract <br />abutting the subdivision on the west, are designated C/I, <br />Commercial/ Industrial Node, a designation which permits commercial <br />and industrial uses. The Indian River Mall property, abutting the <br />subject property on the north, east and west, is designated RC, <br />Regional Commercial. The RC designation permits major zegional <br />shopping centers designed to accommodate the needs of the retail <br />market area extending beyond the boundaries of the cot,.zYy. <br />Environment <br />The subject property contains many large protected caks. No <br />wetlands exist on site, although the northern portion of the <br />"Bill's TV" site may contain a native upland plant ccmfiunitj <br />According to Flood Insurance Rating Maps, the subject property does <br />not contain any flood hazard areas. <br />Utilities and Services <br />The site is within the Urban Service Area of the county. <br />Wastewater service is available to the site from the West Regional <br />Wastewater Treatment Plant. Centralized potable water service is <br />available to the site from the South County Reverse Osmosis Plant. <br />Transportation System <br />SR 60 provides access to the site. Classified as a principal <br />arterial on the future roadway thoroughfare plan map, the portion <br />of SR 60 between 58th Avenue and 66th Avenue is a six lane divided <br />roadway with approximately 200 feet of public road right-of-way. <br />No expansions of this portion of SR 60 are programmed at this time. <br />ANALYSIS <br />In this section, an analysis of the reasonableness of the <br />application will be presented. The analysis will address:' <br />• the county's response to DCA's ORC Report objection; <br />• concurrency of public facilities; <br />• compatibility with the surrounding area; <br />• consistency with the comprehensive plan; and <br />• potential impact on environmental quality. <br />County Response to DCA's ORC Report Objection <br />As noted in the Description and Conditions section of this staff <br />report, DCA, in its January -30, 1997 ORC Report, raised an <br />objection based on the fact that the county's EAR had not yet been <br />determined to be sufficient. On February 24, 1997, DCA determined <br />that the county's EAR was sufficient. Therefore, that objection <br />has been addressed, and the county may amend its comprehensive <br />plan. <br />Concurrency ofPublic Facilities <br />This site is located within the county Urban Service Area, an area <br />deemed' suited for urban scale development.
