CONCLUSION <br />Based on the analysis, staff has determined that the requested land <br />use designation and zoning district are compatible with surrounding <br />areas, consistent with the comprehensive plan, meet all concurrency <br />criteria, will have no negative impacts on environmental quality, <br />and meet all applicable land use designation amendment and rezoning <br />criteria. The data and analysis demonstrate that the proposed <br />amendment will have an insignificant impact on the county's RAR. <br />Most importantly, the subject property is located in an area deemed <br />suited for medium -density mobile home residential uses. Finally, <br />DCA's sufficiency determination of the county's EAR addresses the <br />one ORC Report objection. For these reasons, staff supports the <br />request. <br />RECOMMENDATION <br />Based on the analysis conducted, staff and the Planning and Zoning <br />Commission recommend that the Board of County Commissioners approve <br />the request <br />Community Development Director Bob Keating advised that this <br />is one of the five items considered by Planning and Zoning on <br />September 26, 1996 and submitted to the Board for approval on <br />November 21, 1996. All amendments were submitted to the Department <br />of Community Affairs on January 30, 1997 and the DCA issued its <br />Objections, Recommendations and Comments (ORC) Report on each <br />amendment. The DCA filed one objection, that the County could not <br />amend its Comp Plan until its EAR (Evaluation and Appraisal Report) <br />was approved. On February 24, 1997 the DCA determined that the <br />County's EAR was sufficient. The Board is now allowed to take <br />action on each amendment. <br />Director Keating reminded the Board that they had discussed at <br />the prior meeting requesting redesignation of only the southerly <br />1200' of this property, which would leave a 120' buffer. Staff is <br />recommending that the entire piece of property be rezoned and <br />redesignated. If only the south 1200' is rezoned, the applicant <br />would have a right to request development of the north 120' as <br />single-family residential. Staff also believes that the existing <br />LDRs provide adequate buffers. <br />Commissioner Adams expressed her concerns regarding the <br />adjacent property owner and felt compatibility of use was not being <br />taken into consideration. <br />Leah LeFeve, a biologist at Kerr Center, wanted to again <br />propose the additional buffer. Kerr Center is an extremely <br />important research site for the USDA and is concerned about <br />possible noise conflicts. They spray at night, often up to <br />midnight, which is extremely loud. They also have a diesel pump <br />directly adjacent to the subject property for irrigation which is <br />also very noisy. <br />Commissioner Adams felt it is unfortunate that existing <br />agricultural operations are now running into conflicts with other <br />zoning categories. Agriculture makes money for this County and <br />does not cost as much for services.
