BOOK 1UJ FAGV28 <br />wanted to advise the Board that the wall designed by staff will be <br />cutting into their property and destroying what is already very <br />strong. He claimed that at the time the emergency permit was <br />approved, they did not know that it was 15 feet from their <br />structures. <br />M.B. Millar, 3766 Ocean Drive, thanked the Commission for <br />showing every consideration and he fully recognized Commissioner <br />Adams' concern. He did not blame staff nor his representatives for <br />what had occurred at the prior meeting when the permit was <br />approved. The main impact was on Mr. Somoza's property and was not <br />a disaster to the Millar property. He wished that Mr. Mosby could <br />present something this morning that would be satisfactory to <br />Commissioner Adams. He urged the Board to give serious <br />consideration to a seawall at the top of the bluff to the south end <br />of Mr. Somoza's property. <br />It was then determined that staff was just this morning seeing <br />the sketches that Mr. Mosby submitted. <br />Director Davis made the point that on the Somoza property <br />there is a substantial distance from the top of the bluff to the <br />dwellings and he wondered whether an emergency is appropriate now <br />that we're moving into the accretion time of the year. He thought <br />that perhaps it would be less risky for the property owners to <br />apply to DEP for permanent seawalls and take out the temporary <br />nature of the situation. He believed there was enough time for the <br />process to be completed before the October northeasters and more <br />aggressive erosion conditions. <br />William J. Stewart, Attorney at 3355 Ocean Drive, representing <br />Mr. and Mrs. James Clemens who own property to the south of the <br />Somoza property, advised that he was not there to debate the merits <br />of the permit because it was not his area and his coastal engineer <br />was not present. He supported Commissioner Adams' motion to table <br />for the same reasons Mr. Millar mentioned concerning his lack of <br />information. He also found it inappropriate to consider a plan <br />received just before today's meeting. He understood that staff had <br />requested these drawings earlier. He did not see how a rational <br />decision, fair to everyone, could be made without giving an <br />appropriate time for review. He pointed out that it is not a small <br />change on the Somoza property, not much on the Millar property, and <br />he thought it was worthy of extended consideration. <br />Coastal Engineer Jeff Tabar advised that staff's alignment was <br />chosen in conjunction with DEP to afford protection to the <br />homeowners and taking into consideration the environmental factors. <br />32 <br />March 25, 1997 <br />
