Staff had requested the engineering design plans previously and <br />they were willing to give further consideration to the matter. <br />In response to Commissioner Ginn's question, Mr. Tabar advised <br />that under an emergency permit, work on the seawall could continue <br />during turtle nesting season. <br />Responding to Chairman Eggert, Mr. Tabar said he was still <br />awaiting engineering plans. Mr. Mosby advised that the final <br />design of the sheet piles cannot be done until they have the final <br />alignment to determine whether they will use cantilevered sheet <br />piles or "dead men" between the structures and the wall itself. <br />Chairman Eggert pointed out that a line was approved at the <br />previous meeting. <br />Mr. Mosby claimed that they had submitted drawings over 6 <br />months ago that had the alignment that was not approved. It was <br />changed in the configuration. <br />Chairman Eggert assumed that they would do now what they had <br />proposed 6 months ago, and Mr. Mosby advised that was what they <br />were proposing, that they had been revised several times since they <br />were submitted. <br />Director Davis advised that staff had received the first plan <br />on January 13, 1997; they did not see plans 6 months ago. The plan <br />they did see showed the seawall seaward of the top of the bluff, <br />which they knew was not acceptable to the DEP. DEP's position has <br />been 15 feet off the dwelling, or at the top of the bluff, <br />whichever is more landward. Because the swimming pool is in a very <br />seaward location, it will be very difficult to get the "dead men" <br />installed by the swimming pool. <br />Commissioner Adams felt that in some instances DEP had not <br />looked objectively at applications, but her main concern was to <br />remove the Board from the middle of this problem and have good <br />communication between staff and the applicants. <br />Chairman Eggert asked if staff could bring the matter back to <br />the next meeting, if they receive the engineering plans on Friday. <br />Director Davis advised that Friday was a holiday. Commissioner <br />Adams added that there would be no time for revisions either. <br />There was some discussion as to which comes first, the <br />alignment or the engineering drawings. <br />Commissioner Tippin, wanting to cut through the bureaucratic <br />nonsense and adding that the dune line had changed considerably <br />since his youth, thought that simple logic and common sense would <br />dictate that by taking a string from the north end of the Jelmby <br />property to the Millar's would provide an alignment for a seawall. <br />Chairman Eggert called for a second to Commissioner Adams' <br />33 <br />March 25, 1997 BOOK .1LU0 PAGE <br />L- <br />
