The original project was approved on September 17, 1996,.with a <br />budget including contingency of $62,295.30. (See attached agenda <br />item and minutes). The total preliminary construction cost was <br />$48,996.00. The awarded construction amount to Treasure Coast <br />Contracting was $8,800.00. The final materials and equipment cost <br />was 19,882.40,(i.e., U.S. Filter and ABS pumps), in house materials <br />and labor was $2,500.00 which equates to a final project cost of <br />$31,182.40, a savings of $17,813.60. <br />The staff of the Department of Utility Services recommends that the <br />Board of County Commissioners approve and execute the attached <br />final pay request from Treasure Coast Contracting as presented. <br />ON MOTION by Commissioner Adams, SECONDED by <br />Commissioner Ginn, the Board unanimously approved <br />the final pay request from Treasure Coast <br />Contracting and authorized the Chairman to execute <br />same, as recommended by staff. <br />DOCUMENTS ARE ON FILE IN THE OFFICE OF <br />THE CLERK TO THE BOARD <br />OSLO PLAZA ASSOCIATION - IMPACT FEE CREDIT <br />The Board reviewed a Memorandum of March 26, 1997: <br />TO: The Board of County Commissioners <br />FROM: t; William G. Collins II - Deputy County Attorney <br />DATE: March 26, 1997 <br />SUBJECT: Oslo Plaza Associates Impact Fee Credit <br />On March 17, 1997 our office received a notice from litigation counsel on behalf <br />of Oslo Plaza Associates, Inc. notifying us that they intended to file an action <br />seeking declaratory and injunctive relief, costs and attorneys fees if their client is <br />not allowed a traffic impact fee -credit of $119;336 pursuant to an arrangement <br />between the Board of County Commissioners and a previous owner of the <br />property they now own. <br />SUMMARY <br />• By letter dated December 7, 1990, the attorney for Oslo Plaza Associates, a <br />Florida general partnership (a previous owner) delivered to the Public Works <br />Director copies of an executed warranty deed, a partial release of mortgage, <br />and a title search. <br />• On December 11, 1990, the Board of County Commissioners approved <br />purchasing Oslo Road and 27"' Avenue right-of-way (northwest comer) by <br />granting a traffic impact fee credit in the amount of $119,536 and a cash <br />payment of $77,450. <br />• Pursuant to Board direction the staff delivered payment in the amount of <br />$77,450 and the deed was recorded January 3, 1991. Also, National <br />Westminster Bank, USA, executed a partial release of mortgage as to its <br />interest in the right-of-way transferred.
